My guess is Osweiller (his agent) is using the Texans as leverage.
It's probable but you have to keep in mind the Broncos are limited in cap space even after Peyton Manning's retirement. They are practically letting two good defensive lineman go with no chance to re-sign either of them unless they lose Brock Osweiler.
They already franchised tag Von Miller. Ideally, they would have liked to have franchise tagged Brock Osweiler if they had gotten a long-term deal done with Von Miller last off-season.
Not being able to franchise tag Osweiler hurt them.
It allowed him to enter free agency. The Texans now have a shot.
The Broncos can't offer much more than $15 million a year over a three-year deal to Brock Osweiler. Which is what they reportedly offered (and a performance-based contract at that).
The Texans can top any offer the Broncos can make. I don't really consider that leverage. Unless you think the Broncos will increase their offer another $1 million or $2 million per year? If they do that they'll lose every other key free agent they have. Their D-Line depth would be thin.
The Broncos are already offering the best they can.
Leverage to me means you can do a lot more, IMO.
When every team realizes your salary cap situation it's tough.

Me thinks the Broncos need to move on and focus on signing RG3. They may have to draft a quarterback at the end of the first round as well.
