For some victims, taking their assault to police can seem hopeless.

Not only are they retraumatized each time they have to describe their assault, Boyce said, but it can also seem as if they are not in control of the outcomes.

“In criminal cases, the state doesn’t represent the victims, they represent the state and they control every aspect of the case,” Boyce said. “And so often (the cases) are refused for prosecution for a variety of reasons — if they think they can’t win or they think there’s too much political pressure.”

The criminal investigation process also is intrusive and time-consuming, with court hearings, follow-ups with police and medical appointments, said Olivia Rivers, executive director of the Houston-area advocacy nonprofit The Bridge Over Troubled Waters. Officers may show up at the victim’s house or workplace. Family and friends — whom the victim may not want to tell about the assault — may be interviewed to corroborate the report.

“A sexual assault exam can take hours,” she said. “How do you explain to your family why you were at a hospital for that long? Or how do you explain to your employer why you had to miss so much work for court?”

Additionally, the burden of proof also is lower in a civil court than in a criminal prosecution. Civilly, the victims have to show only a preponderance of evidence, but in criminal cases, authorities have to prove beyond a reasonable doubt that the assault happened.

Therefore, it can be easier for victims to get some form of justice in a civil court, whether it be a public apology or a monetary award for pain and suffering — especially when there isn’t enough physical evidence to criminally convict a perpetrator.

“Sexual violence ... isn’t taken seriously by society,” Rivers said. “This is about having their voices heard.”

Sometimes, victims might seek both criminal prosecution and civil damages.

Addicts/alcoholics lie to themselves all the time. Being able to be honest with yourself is key to recovery. From 12-step book: Those who do not recover are... usually men and women who are constitutionally incapable of being honest with themselves. There are such unfortunates. They are not at fault; they seem to have been born that way.

Her story is consistent.

The things she heard about Watson led to her professional decision. She's saying that conversation she had with her friend was private.

But yes, her credibility is shot.

She never experienced an unprofessional session with Watson. She heard he started doing unprofessional things with other girls. She made a business decision to stop doing business with Watson.

Now, one might wonder why she would value her friends word over her own experience. & you could presume she is lying.

But at face value her statements kills her value to Watson's defense.

We were covered all over, because of Deshaun (and others) before this mess.. had plenty of primetime games too.

However the attention we're getting now is not the kind you want. There's famous and infamous, both get hordes of attention, and Watson crossed over possibly dragging the organization with him..

At this point I just want to watch it all burn to the ground, lol.. Getting hopeful that somehow ownership can be implicated in this mess and the league has to step in and force a sell. Goodell would instantly go from my second worst commissioner (Adam Silver is just a pushover coffee runner) to my favorite. ANYTHING to save us from this dysfunctional **** show.. These people are starting to make me have fond memories of Bud Adams and actually miss the old fart :)

This is a good point. I doubt we will ever know but I’d love to see the extent the organization went to to help this guy with his problem only to be slammed by about everyone outside the organization and especially by DW.

Not to burst your bubble but Texans are not going to get dragged into this. First of all I doubt they actually knew anything about this, being idiots about how to run a football team does not equal being evil enough to help and cover up someone sexually assaulting women and if they were why would Watson be trying to get away from the ones covering for him. Second the league can't force the Texans to do much of anything, they can fine them, they won't, but the Texans are privately owned and unless there is proof of criminal actions by Janice McNair then yeah they are untouchable. Finally don't know why people keep forgetting this but Goodell is not the person who watches the watchers he is the chief henchman of the watchers and executes their will.

Even if it is just 1 legit guilty charge that's more than enough for me. He has shown a pattern of locating women on Instagram. What is he trying to get from them doesn't matter. If it was a dating site I can understand why you messaged multiple women but it's Instagram. Meaning he is up to something that is not 100% moral. Furthermore, former NFL players are saying they never used 1/4th of the therapist's Watson has. Plus, the Texans would have been happy to give him a personal massage therapist. So he is solicing for something. Meeting his GF on Instagram is not helpful for his defense. It shows that he has been using Instagram to find women for only God knows what. Sex, massage, relationships or something else a fetish maybe. Nomatter how you look at it he is up to something that should not be tolerated because it is not "clean/smart" behavior.

Frankly that is worded in such a way as to leave as few loop holes as possible, cover only the situation in question and explain every point with as few openings to questioning as possible. In other words it was either written by a professional or she was coached and told exactly how to write it and what to say no doubt with an editor reviewing prior to it being posted. This has Hardin's team fingerprints all over it.

If they did try to nip this Watson stuff in the bud, it doesn’t erase the increased ineptitude this organization has portrayed since Bob died. I don’t put any blame on them for this Watson mess, in fact, I think it’s very possible they were trying to help him not get to where he is, but that doesn’t give them a pass for everything else.

Watson may be scum, but the Texans are still a joke of an organization.

You really think Hardin would call her as a witness? At most he would have a written statement submitted to the court as evidence of character and Buzbee would have a hard time convincing a judge to let him call her as a witness. Even then the most he really could ask her about was "Did you have a relationship with the defendant" and hope she makes the mistake of thinking he meant intimate relationship or "Did the defendant ever request or imply services beyond a massage" and hope she says anything except "No". In other words not worth calling her up. Even her texts to her friend would be hard to get submitted as evidence because I doubt Buzbee got them through completely legal means. This is strictly a counter punch in the battle for public opinion.

She’d better watch herself. She might talk herself into her own troubles with the law. She’s setting herself up to have all of her text and social messaging records subpoenaed, along with every person she has been messaging and all of their text and social messaging records subpoenaed. If people were referring Watson with any knowledge of prior misdeeds to unsuspecting masseuses..... well, she’d better have her own representation.

Latest Rusty Hardin statement on behalf of Deshaun Watson could backfire

Not every development in an inherently public controversy requires a response. Sometimes, the best response is no response at all.

On Tuesday, lawyer Rusty Hardin arguably would have better served his client by not responding to the compelling presentation made by Ashley Solis, the first of the 22 individuals suing Deshaun Watson for assault and harassment to attach her name to the litigation and to speak publicly regarding the situation. Hardin’s lengthy statement seeks a “gotcha” moment by attacking this specific claim made by Ashley Solis during her presentation to reporters: “People say that I’m doing this just for money. That is false.”

Hardin’s statement attempts to characterize that as a lie, and in turn Ashley Solis as a liar, by sharing chapter-and-verse details regarding settlement discussions that occurred before her lawsuit was filed three weeks ago. Although Hardin uses the term “hush money” to describe the opening settlement demand, the email messages disclosed by Hardin reveal the standard type of pre-litigation communications in which lawyers engage in an attempt to resolve potential claims without litigation by going back and forth in the hopes of reaching a consensus.

The emails confirm that the opening demand of $100,000 wasn’t made in an unethical or improper manner but in the normal way that such matters unfold, with one attorney alerting another attorney to the existence of a dispute and with both attorneys trading messages until the dispute is, or isn’t, resolved. The opening demand wasn’t eye-popping, given the usual value of civil litigation involving claims like those at issue here. Solis, through attorney Tony Buzbee, requested $100,000. This means that, through the process of negotiation, Solis and Buzbee eventually would have accepted less. Most likely, the case would have settled somewhere between $50,000 and $75,000.

The emails produced by Hardin show that the demand wasn’t being viewed as extortion or blackmail but as a legitimate effort to resolve the case.

“ wanted to check in on this to see if Ms. Solis wanted to either help us understand the rationale behind the $100k demand or come back with a different figure,” Scott Gaffield wrote on Watson’s behalf. “As I said to [attorney] Cornelia [Brandfield-Harvey] last week, we don’t believe that the alleged facts show that Deshaun did anything wrong with regards to Ms. Solis, but we are nevertheless happy to continue the conversation around a reasonable settlement figure because we believe he can learn a lesson about having put himself in this situation.”

In other words, Watson’s camp was willing to consider paying something to settle the case because, as Gaffield said, “we believe he can learn a lesson about having put himself in this situation.”

Amazingly, Hardin’s team voluntarily disclosed this communication, which otherwise was confidential and never meant for public consumption. It shows that Watson’s representatives viewed the claims made by Ashley Solis as something that weren’t frivolous but that instead provided a useful opportunity to teach Watson a “lesson about having put himself in this situation.”

Isn't this what DW4 was was so pizzed about at the Texans: they were interfering with his off field activities to keep him out of trouble, so he rewarded them demanding a trade. Had he listened to them he might not be in this mess - talk about irony.

I think he is looking to decrease the number of plaintiffs or paint them all with a broad brush.

If he go get pictures of their Instagram accounts, paint them in a bad light, he may be able to lessen the blow of a settlement and change the story.

The thing with that, is many of them are licensed. Doesn’t help that Watson went to IG when he had masseuses available through the team.
 
No team is gonna want a rapist on their team. Sure, in his prime Mike Tyson was the most recognizable athlete in the world & he was convicted of rape, BUT, Iron Mike only had one accuser. Watson, on the other hand, has so many accusers he can't even keep track!

Btw, I think Tyson was set up!
 
Last month I was checking the Watson updates and this board multiple times a day to see if we made an agreement on a trade and how many number 1’s we would get back. We were seemingly in a good spot whether we traded him for a bounty or kept him as the leader of the franchise and slowly built around him. Now I’m checking the updates and this board just as often but to see if he’s cut or arrested or on the NFL exempt list, etc. It’s depressing. What a juxtaposition.

Someone else knew. That much is clear. Watson may have even mention in passing about a massage therapist that "almost did _____". Or if it is fact that the QB coach knew. And then the NFL is going to dive head first into any player or coach that has been on the staff since Watson was drafted. Clemson is also going to be looked into. Seeing it has been said that Watson has been doing this "even during his Clemson days" by a few articles.
 
All legal arguments aside, I'm still quite puzzled over Hardin's insistence that somehow not being given the complainants' names compromises Watson's ability to pursue his defense. All the suits filed would have the dates and the locations that the "encounters" occurred. Between Watson's different communication accounts and Hardin's resources, tell me that there's not something a little fishy if all the information they need has not been obtained by now...........without the divulging of the complainants names in the filings. Hardin needs to stop calling the kettle black.

Valid point. And perhaps Amy was fired because she was starting to hear things. Being a female and in the FO she was possibly able to learn about things. So, fire her before she could go public with anything. She is said if I remember right to sue the Texans. She didn't have a case we thought. As it turns out she may have a smoking gun. Just a what if, but a HUGE one if it is/was true.

Now that you mentioned that it is fishy. It's not a situation where you have a change filed and never have a name tied to it. The complaintants have a right to privacy to the public. However, the name and state of each is not hidden from the lawyers. I think Watson's lawyer is just trying to scare them away. It won't be easier to get off (you can take the pun but not intentional) if you are only up against 1/2 or less than the current 20+. He may think IF he can get them thinks they are going to publish their names...they may drop the charges. Either way you look at it, your right it's very odd a lawyer like Watson's is nonstop says things about not knowing names.
 
i wonder how honest DW has been with his lawyers and how early he came completely clean to them.

i can imagine him downplaying everything & possibly not mentioning all the phones he's been using. Hardin for sure pressed him on telling him EVERYTHING from jump...

Apparently he was paying via cash app ..... those transactions are easy to track. They know exactly who these women are , without a doubt.

Exactly why what Cloak said is so true. It HAS to be an attempt to scare them into dropping charges. If they don't want to have a name in public. Only thing is they should know that even if they have every name. Legally it can't be published. So why say it every day 🤔
