Criminal has a whole different standard of proof than a civil complaint. In these he-said/she-said sorts of things, it's almost impossible to meet the level of certainty needed for a criminal complaint.
This is not true. A complainant has to be deemed “credible and reliable” by the investigating officer, which happens very often. A complaint can be filed with little, or circumstantial evidence and cases can be convicted on circumstantial evidence. I’ve seen a criminal complaint filed for a misdemeanor case for harassment based on what the woman said and that it offender her. You also don’t necessarily need proof to file a complaint with the investigating agency. The complainant needs to be deemed credible and reliable, and sign a sworn affidavit saying a crime occurred, that’s enough. Then the officer will investigate.

I apologize. I was imprecise. The "level of certainty" I was talking about wasn't about filing but about winning the case. I was just saying that "beyond a reasonable doubt" level of evidence required for criminal cases is harder to meet than the "preponderance of evidence" or "clear and convincing" level for civil cases.
 
I’m basing this on the 2 new ones who came forward after Watson was traded. So did Watson, his agent and Hardin give the Browns all the facts? If more women continue to come forward…..that could give the Browns more ammunition to make their case.

Remember the Browns said they did a thorough investigation, the most thorough in their history.

Yet they didn't speak to a single one of the complainants .... nor did they speak to Buzbee or any of his associates or the police officials who conducted the investigation.

That trade is done .... they are stuck with the poo on their shoe.

I said, they may have an out of the financial portion of the contract if Watson is suspended for 2-3 years based on their fact that more women have come forward since Watson signed his new contract. If any more come forward, the Browns could say that during their talks Watson assured them there were no other women. If they win the civil cases and Watson is dealt a long term suspension…..this may be the Browns out of their financial obligation to Watson since they would release him for conduct detrimental to the team. As for the trade, they’ll have learned a very costly lesson in the process…..losing those picks is going to leave a mark.

I think it will take a "New" accusation for the Browns to get out of that contract, those cases that occurred prior wouldn't cut the legal muster to terminate it - they knew what they were getting into on those.

There are several potential cases out there, both civil & criminal to make this happen.


The one thing that may save the Browns is the league suspending him for all or most of that contract and from what I've heard the suspension will be indefinite which could end up being permanent.

He was so used to getting massages on the reg, that he brought an item with him whenever possible. According to the latest reports, Watson would bring a small to medium sized towel with him when getting massages. This is something that he liked to have, rather than be furnished with one from the massage therapist. Watson even testified about it in a pretrial deposition May 13. The accusers attorneys say Watson’s bringing a personal towel to massage sessions is evidence of his intent for sex.

This practice isn’t normal and is not advisable, according to a massage and spa industry expert contacted by USA TODAY Sports. That draping also is usually large enough to make sure there isn’t any unwanted exposure if the clients are nude or in their underwear underneath.



The attorneys for the accusers believe his towel worked two-fold.
One it would expose himself so he could get what he wanted out of the massage, and two it would be his to take home as not to have his DNA as evidence.
“They say his insistence on bringing a personal towel to these sessions is evidence of his intent for sex and not simply a professional massage. Their lawsuits suggest the towel he brought was small enough to make it easy to expose his private parts to these women during these encounters. The attorneys also say he brought his own towel so he could take his towel back with him, lowering the risk of leaving any DNA evidence behind.”


Watson’s lawyers did acknowledge his preference for bringing his own towel.
“He’s always made it clear that for comfort reasons, he wanted the least draping possible that still covered him,” Watson’s lead counsel, Rusty Hardin, told USA TODAY Sports in an interview June 2.

Watson was directly asked why he brought a towel:

“Why did you bring a towel?” plaintiffs attorney Maria Holmes asked Watson during the deposition.
“Because that was – we talked on the phone and I told her I was bringing a towel,” he replied. “We communicated with that and that’s how it was.”


His towel preference became known as his “towel trick.” I totally believe in innocent until proven guilty but none of his actions pass the sniff test.
He absolutely stinks of sexual misconduct.
 
I agree 100% with Amy – and do not understand how the NFL did not remove him completely from football. Their rules do not call for any kind of proof and evidence and by those standards my opinion is they had the right to remove him.

Deshaun Watson ultimately wasn’t charged by a grand jury in Texas over allegations that he sexually assaulted more than 20 massage therapists. And the 24 lawsuits against him are still to be determined in court.

Deshaun Watson's salary this year is $46 million, but $44.965 million of it comes in the form of a signing bonus, which would not get touched if he is suspended.

But Watson and the Browns look to be in big trouble. The New York Times’s reporting on the lawsuits, which found that Watson visited 66 massage therapists over 17 months, provided vivid details of the allegations against Watson and revealed him as a deviant who used his power and celebrity to prey on women.
Nobody comes out of this looking good. Watson could be forced to sit out yet another season. The Browns look horrible for embracing Watson and still might need to find a quarterback for this year. The Texans are now getting dragged into the lawsuit and could be found at least partially liable. And Watson may find himself in more hot water thanks to the 24th lawsuit that was filed this past week.

Even if the lawsuits come out in favor of Watson, the NFL still has to come down hard. Ezekiel Elliott was suspended for six games for a sexual assault allegation that didn’t result in charges. Ben Roethlisberger got six games and had it reduced to four despite no charges on multiple sexual assault allegations.

Sure his desire to be with so many women is disturbing, but do you think the NFL is going to start dictating how many people players can sleep with? What about how many baby mommas they can have? Or where they can spend their free time? The line isn't so cut and dry with this stuff. The NFL is in a tough spot without actual evidence.
 
It could be that because of the NDAs and potential knowledge of players misdeeds to punish the Texans the deal is null and void because when the trade was signed off on it the NDAs were not disclosed information.

The NFL, lawyers and plenty of snakes in the garden can come up with something if not that to protect "the league" "their team" etc. That get paid to pull things out of their butts for a livong, getting paid far more than I do... but if they want to meddle, they can and will find a way to do so.

I'm pretty sure we knew about the NDA's last year, but someone correct me if I'm wrong.

Haslam and Berry prove once again they aren't smarter than everyone else... I knew this was a bad deal from the get go... Even if they cut their losses... They're still screwed... We're not getting those picks back and Texas is laughing all the way to the draft board... Cleveland deserves better than this... Clearly Watson has lied... I say the season is lost before it even started.. LOL Browns... As a lifelong Browns fan.. I'm embarrassed for this team... This town and it's fans... I just don't see a championship happening in my lifetime ..

Look, the sheer scope of the allegations is unprecedented. This isn't a one timer Ben R. banging some chick in a bar bathroom.
Watson apparently checked his moral compass at the door when he keeps claiming he didn't do anything wrong, and it was all consensual. Sorry Deshaun, not buying it. False like ALL the others? You're dreaming. Add in- earlier in this sordid little episode Watson and his lawyers screwed up by not paying up to make it all quietly go away when they had the chance. Too late now.

When we first signed Watson, I was happy. I defended him. "Ok, he's REALLY into massage girls, likes happy endings, and while inappropriate, his behavior is not criminal. This attorney has a personal vendetta for him and is very good at coaching these women that they have been wronged"
The Browns said they vetted the hell out of the situation and that Watson was a good person and they wanted to build around him.
Watson said he did nothing wrong, and since we were in He Said / She Said territory, and there were no criminal charges ... I was all in on the new QB of the Cleveland Browns.
The NY Times article flipped things for me. I saw him as a different person: He manipulated the Texans, he lied to the Browns, and he lied to us at his press conference.
No one needs 66 different massage women in 17 months. No one needs a luxury hotel room where different massage girls are sent. No one needs a massage girl to sign a NDA unless creepy things are happening.
We traded our future away and paid $243 M guaranteed to a lying creep.
Oh ... my Browns.
The draft picks are gone.
But we can sue Watson for lying and then Jimmy can sell the team to a ******* hands off owner and let the football people run the team.

Eh, his office could get involved upon request from an investigating agency. (There is a public corruption unit within the AG’s office, think it is geared more towards election fraud, not sure). The Texas Rangers tend to investigate public corruption moreso, in which DPS is a state agency. Just look at Lina Hidalgo.

No. He’s likely going to be kicked out for tarnishing the shield in a way no one has ever done before. You say there’s no proof he assaulted anyone. What proof has he shown that he hasn’t? You have an avalanche of allegations and he’s not really disputing any of it. Claiming consensual encounters but not naming who the women are is not a defense.
 
I'm hoping the NDA forms that were left for Watson is SOP for team security to provide to any player on the team that could be putting themselves
at risk. Using outside services can be risky business, especially conversations during the therapy/procedure/massage/AA mtg/Psych therapy...whatever, where the player may disclose something they didn't intend to. I would think with hi-profile players being the targets that they become when they're out there in the real world, this would be something that the Team Security discusses with them at meetings at some point during training camp. It's just a tool that they're provided if they want to use it. The Officials from the NFL come in to talk to them regarding rule changes, financial people come in to talk to them about how to handle all the big $$$ they're making and they meet with Security about staying out of trouble. Security may tell them that if they need a copy of a NDA to let them know and they'll get them one. I'll bet all the teams have these available for their players.

Yes, but most were not aware of the potential backstory to those NDAs.

My employment comes with an NDA as do Im sure many here... NDAs are not in themselves a red flag. However if the Texans supplied him those NDAs BECAUSE they knew what he was doing/providing the means to enable that behavior.... then its another issue all together.

I think it’s possible that Watson told the Texan’s head of security about this one altercation. And how she is making up things. At that time it was one women. Definitely believable that this was a one time thing. Then the Texans give Watson the NDA to use for future use.

By that time the Texans wouldn’t have known about the 60+ massages and the multiple potential allegations.

The Buzbee complaints first went to Watson’s team - his marketing manager/lawyer.

Then Buzbee went public. Then all the women came forward.

I think it wasn’t until December 2020 that things started to get out. But it wasn’t fully public.

I posted that part of the collective bargaining agreement long ago that statea that if a player does anything's that is a detriment to the team or the league they can be dealt with.

The NY Times article says days later he got the NDAs from the Texans.

The "initiating" post was early Nov 2020...........the NDA was given to him mid Nov 2020.

Kids and women are a big fan base. I’ve already quit on the Cheatstros. SCrew the NBA. NFL is real close to being next.

Back in 2017, a harmless clip was posted online showing former porn star Mia Khalifa trying to dunk on Deshaun Watson with a mini hoop behind him. Jokes were made at the time, but we had no clue how things would come full circle with what the Browns QB is dealing with these days.

The then-Texans rookie quarterback woke up on his 22nd birthday with a happy birthday message from former porn star Mia Khalifa and the rest is history.
I'm sure it was completely plutonic. He had a girlfriend!
 
Watson's a creep, a slimy creep. Would not want him in the same Zip Code as my daughters. And Jilly, the GF, she should have taken a baseball bat to him as he slept. Jilly is an enabler as far as DW4 is concerned, and NOT a friend of women who have been abused by the likes of men like her BF. She discusts me almost as bad as Watson.
I'm so glad he's Cleveland's problem now and just hope we're not found culpable in his actions in any way.

NFL is not voiding the trade because they already approved the trade. People seem to keep forgetting that the NFL had to review and sign off on the trade. Likewise NFL can't "void a contract" because those are between a player and the team and NFL has no authority over that. What the NFL basically can do is say we are not allowing him in any NFL officiated games. As a real world example say a person is contracted to John Doe Inc. and they have a contract with a large company like Exxon. Now Exxon finds this person violated whatever rule they have. They can not, by law, dictate that John Doe Inc. fire this person all they can say is we do not want him on any of our sites anymore. Same here, NFL can't say Browns can have no dealings with Watson they can just at most say we will not allow him in our games anymore.

The whole "Texans knew" thing is a hype machine the media is trying to build up to make this a bigger story than it is. IF the Texans actually went to court, which they won't because its cheaper and better for them to just settle out of court, the case would have no legs because negligence of a company is very hard to prove. Buzbee would have to show hard evidence that the Texans knew and were hiding it and one of their people giving him an NDA form that you can go download off LegalZoom won't cut it. Far as the hotel room again he would have to show that it is far outside of normal for a team to provide a player with a luxury hotel room and we know its not so that wouldn't actually hold water and even providing massage tables that was most likely the reason the equipment manager was fired so they can say that they corrected the issue as soon as they were made aware and put procedures in place to prevent it from happening again. All this is standard, everyday stuff for companies and lawyers.

The real saving grace for the Texans though is Buzbee asking Watson directly if the Texans were aware and him saying they were not. Watson had no reason to protect them at that point so if Buzbee seriously tried to sue them, which again he won't he's just looking for a quick settlement, that gets played and the whole case is destroyed.

Read the Texans forum description. "Football talk only please. Keep it to the game, the players, the coaches and management." This is not football talk. It's about allegations and lawsuits. In retrospect, this thread should have been placed in the non-sports forum. But is wasn't, so this is where it will live.

I remember @CloakNNNdagger specifically state that the Texans had no knowledge of Watson's actions during the timeline of the allegations. Why he now believes Buzbee's assertions that the Texans were complicit is confusing to me.

The NDA is really for the protection of the Texans, is that correct? I guess two things come to mind. First a massage doesnt mean a prostate exam. If this news is true why would they set up DW in a potential rumor mill like the high profile Houstonian? Were his Houstonian massages performed in a facility for that purpose with Houstonian masseuses? Maybe the Texans heard he was seeking massages from private masseuses and they were trying to avoid that embarrassment to the franchise. To me that would better explain their culture. Second thing is if DW said the Texans didn’t know about the nature of his massages was that the NDA talking and only relevant to massages at the Houstonian?
