Do we know the context of that message? That could literally mean anything. Maybe he had a small towel but covered up, maybe he farted, maybe he went to kiss her afterwards and she said no, so he apologized. That doesn't mean he harassed or assaulted her.
Playing devil's advocate. If there are text message(s) asking the therapist(s) if they would be comfortable massaging his abductor longus muscle (thigh, inner groin). Since we are seeing a pattern with the allegations, should we also assume he was asking if they were comfortable before some of these sessions?

All we have is someone's word either way.
One of the attorneys was talking about follow up conversations or something of that nature. Watson's reply tweets "Are you ok." Falls in that category. Buzbee said he's got a witness one of the ladies confided in after the incident.

Hardin says several of the women had as many as three appointments with Watson after the fact. He says he has witnesses saying these women were so pleased to work with Watson they talked to their friends about how good the experience was.

If any of this can be documented (sworn affidavits, testimony in court) it would add weight to whichever side & the other side would have to argue.

NFL great Warren Sapp was dropped by the NFL Network for buying a dildo for a female co-worker & urinating in front of her. What Watson allegedly did is much, much worse. Watson, most likely, will never take another snap!
Sapp's is an HR issue. Every company in the world would have fired an employee that did that, or else the company becomes liable.

Just like if the Texans were to become liable for DW's actions (which they aren't), then they'd probably cut him.

I'll try to answer your question in understandable terms.

The request for these 2 areas are not unusual in athletes. However, therapeutically, the TRIGGER POINTS of these muscles are where the massages are specifically directed. For the adductor [NOT ABDUCTOR LONGUS.......no such muscle] longus, the trigger point is well away from the actual groin (and the area of the penis).

There is one essential/primary trigger point in each muscle, but they both refer the same pain pattern into the groin, down the anterior thigh and into knee as one unit.

As relates to the abdominis [NOT ABDOMINUS] rectus muscle (the six pack) , the trigger point associated with its local pain (which is why most athletes, especially a QB, request the massage) is just below the umbilicus (belly button)............again not in the area of the penis. [There are 2 other trigger points located higher and lower, but these not for pain in the abdominal areas...........see video]

The problem is that in the filings, the masseuses stated that when supposedly massaging the groin pain, Watson kept requesting that the massage be directed higher near the scrotum/base of the penis (away from the appropriate therapeutic adductor longus trigger point). When supposedly massaging the abdominis rectus pain, he kept requesting the massage be directed lower near the base of the penis (away from the appropriate therapeutic rectus abdominis trigger point).
He more than likely used those terms to get a foot in the door, or at least her finger in the door. His trigger point was a few inches away.

Hardin now saying he still doesn’t know who 4four of the women are because there are multiple people with the same name. Hardin is therefore asking for the social security and driver’s license numbers to confirm identities.

Strange that possibility wasn't anticipated by a seasoned attorney like Hardin.

The attorney, Tony Buzbee, made the accusation after Watson’s attorney, Rusty Hardin, said Thursday during a court appearance that Buzbee’s clients also had deleted or altered messages on social media. All of these messages are considered evidence that could help show whether the Houston Texans star engaged in sexual misconduct with these women during massage sessions.

“Once we get those phones, whether you deleted something or not, Deshaun Watson, we’re going to know everything you’ve ever written and ever said and ever sent,” Buzbee said during a court conference Thursday in Houston that was livestreamed. “And the same is true on our side.”

Hardin said in court Thursday he believed some of the plaintiffs “have been destroying and altering some of their previous postings.” He also said he feared it would continue to happen without an order from the court.

Buzbee replied that Hardin is “flat-out wrong” and said he sent a letter to Watson’s legal team to preserve both of Deshaun Watson’s phones “that I know he owns.”

“And I know that after I sent that letter, Deshaun Watson unsent … his Instagram messages to many of my clients.”

One of Buzbee’s clients filed a lawsuit in late March that said Watson is “deleting Instagram messages” as a result of the lawsuits against him.

Hardin then issued a statement in response:

“Deshaun regularly deletes past Instagram messages. That said, he has not deleted any messages since March 15th, the day before the first lawsuit was filed.”

Both sides had sent notices to the other to preserve evidence. After listening to both sides, Judge Rabeea Sultan Collier did not take further action on the matter.

“I have full confidence the lawyers understand there are severe penalties in destroying or altering evidence,” she said in Harris County, Texas. “And it sounds as if both sides have sent over preservation of evidence notices to the other side.”

She said the court will deal with evidence destruction issues if they come up.

I’m sure Buzbees clients have the messages saved that were sent from DW??? If not It’s incumbent to get those phones which, btw, could broaden the scope in regards to more women and perhaps other activities or it could help him. I doubt it or he wouldn’t be deleting material. But this could hopefully lead to this crap being settled sooner.

imo, this is a fishing expedition by Buzzbee aimed at trying to drum up more potential victims and make DW4 more uncomfortable by invading what little privacy he has left.....mainly b/c he knows some of clients probably did in fact erase messages after they were told not to and b/c he’s lost a little steam in his strategy of pulling on the heart strings....hence his statement acting as if he’s talking directly to DW

The direct messages can be retrieved from phones, unless they have been deleted AND overwritten. However, there is a question re. the server non-retention of the direct messages. It is related to their ability to "clean up" their servers, which have a lag of ~ 90 days. There have been retrievals of these deleted messages by some for over 1 year since deletion. Since Instagram is essentially now a subsidiary of Facebook, I would not trust anything they put out re. their deletion policy.

Buzzbee's trying to play the tit for tat game like he did in the court room when they were asking him to give up the names. I believe he knows that some of his clients did in fact erase messages after the fact so in essence he wants to get access to DW4's phones not only to drum up more potential litigants, but also to say "see! he did it too!" to help them save face. It's just poor strategy when you're trying to convince judges and jurors - not regular joe schmoes like me on the outside in the public, that your clients aren't just out for a big pay day.

But then again...im not a super lawyer so what do i know. I just hate everything about how Buzzbee and his clients are going about this. If DW4 did any of the things he is alleged to have, he deserves to fry, but i just don't see how Buzzbee can prove to jurors that he did. Hardin and DW4 are calling him to the mat to produce evidence & all he's done is do everything he can to ratchet up the pressure on DW4 through the public. &whether we all think DW4 is bluffing about wanting to go to trial, that's got to mean something b/c anyone else in his position would've folded by now just to move on from it and get on with their life. Maybe he does eventually do that, but right now, he seems intent on risking going down with the ship if that what it takes for him to clear his name.

Instagram claims they do not maintain such records for such a long time period. Now speaking as someone in IT I call BS but even still it would require a federal court order to get them to turn those records over and even then you would have a major legal battle to do so. I don’t know if you remember the big battle between the Govt. and Apple over records they were keeping.

Point is this case isn’t a big enough deal, even if it was criminal, to get Instagram to do that and they have the lawyers and money to tie it up in court for a very long time even if it was a big enough deal. Only realistic way to get that information is the phones and depending on what type of phone and if he uses a cloud server any deleted records might can be pulled from that, particularly text messages.

Hate to tell you this Tex but sexual assault is almost impossible to prove to jurors even in the best of cases. About the only way to do it is to get jurors to not trust an accused credibility because hard evidence, no pun intended, is extremely rare. You may not like it and think it’s unfair to Watson but the strategy isn’t that different then other civil cases involving sexual assault just Buzbee is much more public about it.

As far as Watson wanting it to go to trial you can also say that fits into his mental issues of not thinking he did anything wrong just as easily as you can say that supports his innocence.

May be another bluff... that's why most victims don't press charges. They don't want to take the stand. They don't want to be cross examined.

The reality is neither side, at least the lawyers, really want this to go to trial because if it goes to trial all bets are truly off. Juries are weird things and as unpredictable as a feral animal. No matter what evidence and testimonies Buzbee can’t be completely sure that the jury won’t be people that are Watson fans and Hardin can’t be sure that people won’t just see this as Weinstein 2.0. It would be a huge risk for both sides and one that they are rarely willing to take.

I doubt DW4'S charged either in today's climate with the leadership in this city. It's one of the reasons these women went civil instead of criminal.

Watson's team hasn't committed to taking any route yet. In actuality, "scrutiny" has not been applied to Watson any more than to his accusers. That only comes with formal depositions and in court questioning.

Race has nothing to do with it, the issue is that it is very hard to prove full on rape much less sexual assault because there is very little physical evidence and 9 out of 10 cases boil down to he said, she said. Not to mention defense attorneys will make the victims take the stand, because accusers cannot refuse like defendants, and then force them to relive the experience in detail. This causes great mental stress on the victim and if they don't repeat exactly what they filed then defenses will pounce on that and then put them through more stress by doing all but flat out calling them a liar. It maybe a dirty way to achieve their goal but remember their job is to keep their client out of jail.

All of this is assuming of course that police actually investigate it and a DA takes it to trial. Look I get what you are saying and I agree with you that I would rather see them in jail as well as would most victims, but the reality of the situation is that rape is the least reported and least convicted of all crimes. The prosecution rate is only 37% of of that only 18% result in a conviction and thats of what is reported, its estimated that 70% of cases aren't even reported. You're more likely to do jail time for animal cruelty. So to say that going civil instead of criminal is just a money grab is to either not know the facts or to ignore the facts.

True, but they have received death threats. They must really want to get paid to power thru the death threats, as well having parts of their personal lives shared, scrutinized and discussed all over the media for friends, family, and acquaintances to see.

Look I've always thought DW4 was an overrated POS. Most disagree with me. I've got no problem with this.

If posters could learn to look past this 1 issue they might find that we agree on more things than they currently think we do.

How long will this hang over Brown’s career?

The answers all came in time, and they can provide an instructive backdrop to the future of Houston Texans quarterback Deshaun Watson, who is the target of 22 civil lawsuits alleging a range of sexual misconduct.

Watson has the Texans and other teams mulling the same questions about his pending litigation. It's an opaque crossroads that has no discernible ending in sight, barring sweeping settlement mediation (which remains an option) or some kind of unrivaled fast-tracking of 22 individual lawsuits (which is highly unlikely, if not completely impossible).

While the situations of Watson and Brown are different, what’s important to note now is that their civil litigation started in a remarkably similar place: With each player denying the allegations against them and both of their representations defending the players by painting the picture of a woman (or multiple women) contriving civil litigation to extract a settlement. And in both situations, the players denied the claims against them and insisted there would be no settlement.

For Brown, that settlement finally materialized, but only after nearly 20 months of legal combat and near the doorstep of a jury trial that was expected to take place in the next several months.

For Watson, his legal representation is saying what Brown’s lawyer said in the fall of 2019: There will be no settlements and the player intends to fight the allegations in court to reclaim his reputation.

I hope this goes to trial so the light of truth will shine bright.

BTW, anybody who requests a trade 6 months after he signs a 156 mil contract is a POS regardless of how this case turns out.

I don't recall any assault complaints but she allegedly was forcing her assistant and some housekeeper / personal assistants to look at pictures of nude males that she knew. She also allegedly walkedcaeound nude and ask them to make comments about her body. Iirc Fox News paid 4 million dollars to her assistant. Guilfoyle also denied any misbehavior. I don't think any filed Criminal charges so that of course is difference and the NFL angle.

$4 million? I think Bill O'Reilly and/or Fox News paid $32 million to settle his sexual harassment lawsuits. Staying on the NFL angle. I guess Watson can claim NFL players walk around the locker room naked even have interviews with just a towel around their waist. I guess he can use the locker room talk training table defense. :kitten:

For similar crimes women hardly ever pay the same price as men.

All it's going to take is one jury out of 22 to find him guilty. Those are odds that would be dangerous to play a game of chicken with.

I think all of this is just positioning each side for an eventual settlement. JMO
A civil jury doesn't even have to find him guilty. All they have to do is decide they want Watson to give the woman some money. Of course that decision will mean Watson lost the case and make a lot of folks believe he is guilty.

For similar crimes women hardly ever pay the same price as men.
I think you are correct in that there have been a few sexual issues between female school teachers and their students recently. I do not recall any in the last few years that ended up paying anything in a civil action even if convicted criminally.

I feel certain that Rusty Hardin will include that in his defense.
