Under terms of the NFL Collective Bargaining Agreement, a team losing more or better compensatory free agents than it acquires in a year is eligible to receive compensatory draft picks. Compensatory free agents are determined by a formula based on salary, playing time and postseason honors. The formula was developed by the NFL Management Council. Not every free agent lost or signed by a club is covered by this formula.

So to answer your question, yes the Texans could receive compensatory picks if they lose guys like Payne, Banks, Simmons, or Bradford. They would receive the picks (or picks) at the bottom of rounds 3-7 in 2006. Compensatory picks are received from the signing team when someone signs away one of your RFAs that you have already tendered.
If Payne and Bradford are not re-signed and that loss is not offset by new free agent signings, then the NFL top secret formula kicks in and determines what draft picks the Texans will get in return.
