Big Ben accused of sexual assault, again

Good grief, Ben!

TMZ.com reports that Ben Roethlisberger has been accused of sexually assaulting "a young woman in Georgia."

The credibility Andrea McNulty hoped for finally arrives. Big Ben was also accused of raping McNulty in a July 2009 civil suit. The new allegations stem from an incident at the Capital City Club in Milledgeville, GA. The woman has been treated and released from the hospital, but police have already interviewed Roethlisberger. The Georgia Bureau of Investigations is also on the case, though no charges have been filed. Yet.

Need to clarify some things for you under Georgia law. From what I understand, he supposedly just groped her. "Little Ben" was not involved, because that would be a charge of Rape or Sodomy.

The charge is question is "sexual battery".. which is different than rape.
Here is the Georgia law.

16-6-22.1. Sexual battery.
(a) For the purposes of this Code section, the term "intimate parts"
means the primary genital area, anus, groin, inner thighs, or buttocks
of a male or female and the breasts of a female.
(b) A person commits the offense of sexual battery when he
intentionally makes physical contact with the intimate parts of the body
of another person without the consent of that person.
(c) A person convicted of the offense of sexual battery shall be
punished as for a misdemeanor of a high and aggravated nature.

I'm not sure if "just groped her" somehow is supposed to lighten the charge, but let's say someone "just groped" my daughter, or my wife, Georgia's sexual battery law would be the least of Big Ben's, or Little Ben's for that matter, worries.

The fact is the man has a problem keeping his hands, or other body parts, to himself.
 
OK, OK. I've seen enough of this annual song & dance from Ben.

I think this guy is on his way out. I just don't get a positive vibe of where his life is headed.
 
This is noted as his second case of "sexual assault", but it should be considered his first. The one that is in court right now is complete bogus. You don't get sexually assaluted, then brag about it to friends and coworkers, then report it a year later. If he doesn't get off scot-free and then sue that girl for defamation then there is a problem with the justice system.

However, this second case seems a bit more serious.

I agree with ta TB - Innocent until proven guilty .... But damn , this is becoming a trend with Ben. Once I can see him being completely innocent , twice ? There has to be more to it than nothing.

Yeah, but there's been other stuff, too.

Photos, motorcycle accident, etc. I mean, you're an NFL QB. A Super Bowl winning QB. For one of the best teams in the league.

He is wrecking himself, IMO. But it's his life. Live it up, Ben.

Yeah, I guess there's way more that goes on in the private lives of NFL players. Stuff we'll never hear about (but would be shocked to know who did what, etc.).

Still, I think if you're making good money as a player for a sports franchise, you'd sort of slow down and think "Gee, I'm not in college anymore. I might want to treat this like a real job."

I just hope the guy doesn't destroy himself. We've got enough of those stories to last us the next 100 years.
 
Some people would stay away from these kinds of settings when it happened the first time.

But not big Ben. He just cant leave that college tail alone.
 
I really don't know the first thing about Ben's innocence or guilt, but IMO he could give the titty bars and clubs a break. If trouble seems to find you, maybe it's time you move ...
 
I'm very much of the opinion that he's not a sexual predator/rapist. What I am certain of is that Ben Roethlisberger is a dumbass who keeps putting himself in positions like this. The man has very questionable judgement in my opinion and someone needs to try and get through to this guy that he's not made of teflon and that sooner or later one of these chicks whose butt he gropes or who he nails while she's drunk is going to get before the right judge or set of jurors. Eventually someone is going to get lucky and clean out his Scrooge McDuck money vault and possibly throw his butt in jail.

You have to be smarter than this Ben and if you don't learn then someone is going to come along and teach you an expensive and probably humiliating lesson.

Two lessons for Ben. Yankees need to stay out of Georgia and more importantly, guys pushing 30 need to quit partying with college kids. There is NOTHING in Milledgeville but the university (ok and a state hospital) so you know what he was doing there. Its time for Ben to grow up and find kids his own age to play with.

I have been to three Steelers games the past four years with a life long Steelers fan who travels from Vegas for three home games a year. The restaurant we eat at is where many of the Steelers go to eat after a game (can't recall the name) and I have seen Ben there twice and he had an active entourage. One night my buddy spoke with Bettis (I was not there) and asked about Ben after the motorcycle accident, and Bettis said something to the effect of - 'Ben is a great guy, who let's the kid out too much.'

The sexual assault allegations against Pittsburgh Steelers quarterback Ben Roethlisberger continue to pile up.


The latest accusation, reported today, is from a man who works closely with the star: Steelers backup quarterback Dennis Dixon.

According to Pittsburgh police, Dixon claims Roethlisberger assaulted him late one night at the Steelers training facility while the pair were watching film behind closed doors. But Roethlisberger's attorney, Ed Garland, claims no assault occurred.

"Ben is completely innocent of any crime," said Garland. "We question Dennis Dixon's motives."

Dixon, who started one game for the Steelers last year when Roethlisberger was injured, says he has no motive other than wanting to see justice done. But the fact that he waited months to report the alleged incident, and that he would stand to get the starting job if Roethlisberger was imprisoned or suspended, cast some doubt on his story.

Pittsburgh police have spoken to a possible witness of the alleged attack, Steelers quarterback Charlie Batch, but the third-stringer was not helpful.

"I didn't see anything," he said. "I slept through that film session. I wasn't going to play, so I had no reason to stay awake. Plus, it was Browns tape, I think. Extra boring. I hope Ben didn't touch me while I was sleeping."

As the case is expected to devolve into he-said, she said -- only with two he's -- Ed Garland has stressed that his client has no sexual attraction to men, "which make Dixon's claims preposterous." However, Dixon's attorneys have turned over tapes to police that show numerous instances of Roethlisberger slapping teammates on the butt.

"There is a track record with Ben," said Dixon. "That is undeniable now. I hear Byron Leftwich left the Steelers because Ben used to comment all the time on how big his breasts are."

One convicted. (time served, second chance afforded)

The other innocent proven guilty... (albeit, where there is smoke, there's usually fire)
 
I understand Ben is refusing to give a DNA sample and his attorney is supporting this move. I say, arrest him and watch him pee in his pants. Then, you can take a free, legal opportunity to gather his DNA.:tiphat:

NFL star, Ben Roethlisberger, according to authorities in Georgia is the subject of their investigation into a 20-year-old college student's claim that Pittsburgh Steelers quarterback Ben Roethlisberger sexually assaulted her at a nightclub, police said Wednesday. Milledgeville police chief Woodrow Blue said in a statement that his department and the Georgia Bureau of Investigation handed the investigation report and witness statements to local district attorney Fred Bright on Tuesday evening. Blue said his department would have no further comment on the case.


Bright's office on Wednesday acknowledged receiving the report and said he wouldn't make any comment until he had reviewed it.
Authorities were investigating the claim that Roethlisberger sexually assaulted the woman early March 5 at a club in Milledgeville. No charges have been filed, and Roethlisberger's lawyer, Ed Garland, disputed the claim and hired his own team to investigate.
It was the second time in a year the two-time Super Bowl champion had been accused of sexual misconduct. Roethlisberger also faces a lawsuit filed in July by a woman who says he raped her in 2008 at a Lake Tahoe hotel and casino, an allegation he denies. Ben Roethlisberger has not been criminally charged in either case and has claimed counterdamages in the lawsuit.

No. I think its still the second one. I think what it means is the police have investigated the manner and have turned over their results to the DA. The District Attorney will now review the evidence to see if there is enough to call for an indictment and eventually a trial.
 
Looks like the DA did not believe there was a strong enough case to move forward. Legally no charges will be filed in this case.

Whether or not Big Ben is guilty of sexual assault, he is clearly guilty of horrendously bad judgment. He went to a club in a college town to get laid by a college chick. The man needs to exercise better judgment than that. Hopefully he will learn from this situation.

I do think its rather convenient that the club security tapes mysteriously vanished though...
