Well, if all you have to do is post it for it to be fact, why are you asking for facts?
The NFL’s anti-tampering policy outlines the circumstances in which a team may hire an executive from another team to become a “high-level employee,” as defined by the policy. Here’s the key passage from the policy: “If . . . the inquiring club is prepared to offer a position as a high-level employee . . . the employer club may not deny the employee the opportunity to discuss and accept such employment.”
The emphasis wasn’t added by me; it appears in the policy. And the argument would be, if push comes to shove, that this provision of the tampering policy supersedes the Caserio clause, which as applied would prevent him from leaving his non-high-level employee job with the Patriots (coach Bill Belichick obviously runs the show in New England) for an opportunity to become a “high-level employee” with another team.
As one league source has explained it to PFT, at least one other team has had a similar clause in the contract of a non-high-level employee. And at least one other team challenged that clause. And the NFL ultimately invalidated the clause.
So, basically, the Texans could have challenged the Caserio clause. It’s unclear whether the Texans know that. It’s possible that they don’t, given the current dearth of football business expertise in the organization, with owner Cal McNair still getting up to speed and meteorically rising Jack-of-All-Trades Easterby likely not as knowledgeable as he could/should be.

If the Texans had any balls and really felt like he was their guy they would have challenged it and force the Pats to prove it’s legal.
All this without knowing if Caserio even wants to leave New England. It doesn't make sense to me to push the issue if they have no indication Caserio, who has turned down other opportunities, even wants a new job.

Think that’s stretching, why would NE bother to file a no tamper if they weren’t afraid he would leave. Just let him interview and then turn it down, like he did with Miami or if he doesn’t even want to interview then why not just call up his buddies Easterby and BoB and say “Hey guys thanks but I’ve got a lot of things tying me in Boston, you know (insert wife name) is teaching at the university so it’s just not a good time to make such a big move.”
This was a lot of trouble on NE part if they didn’t think he would go anywhere.
I wish the league would step in, but NE always gets what they want. This job was certainly a promotion, yet they “worded” the contract in a way that binds Caserio to the team through 2020. Cal didn’t do anything wrong by asking for permission to interview. Where he screwed up is by either contacting personally, or having someone else co tact him through text, email, or phone conversation that may or may not have been recorded. It’s obvious Caserio wanted the job, otherwise NE wouldn’t have made a big deal about it. It keeps getting worse through his own actions and he keeps getting angrier at everyone around him failing, so he tries to get more dudes from New England or just tries to do everything himself.

O'Brien didn't fire either Smith or Gaine. He may have been instrumental in it by throwing them under the bus, but the McNair's had to actually pull the trigger. I don't know whether to laugh or cry. This show is somewhere between Howdy Doody and Laurel and Hardy.

After the Texans' 30-0 loss to Kansas City in the playoffs, O'Brien took off a couple of days before returning to the film room. First, he evaluated each of the Texans. Then, he turned to prospective free agents and watched tape before filing his report with Smith.
When O'Brien finished, Osweiler was at the top of his list of quarterbacks.
"We came out of the film room agreeing that Brock Osweiler was the quarterback to lead us where we want to go," Smith said.

O’Brien said he watched a lot of tape on Osweiler and talked to people who had coached him and played with him. The head coach is just one of many individuals in the Texans organization who have praised the effort Osweiler has put in since he got to Houston.
