Texas Longhorns linebacker Sergio Kindle ran his car into an Austin, Texas, apartment and left the scene of the accident last week, according to his attorney.

Kindle, a senior who was a first-team All-Big 12 pick last season, hit his head during the wreck and suffered a concussion when he ran off the street and into a West Campus residence early Wednesday morning, the Austin American-Statesman has reported.

"He knew he was hurt at the time and that he needed to go home and go to bed," Brian Roark, Kindle's lawyer, told the newspaper.

Roark said the incident occurred at 2:50 a.m. ET on Wednesday and that Kindle was probably text messaging before the accident, the American-Statesman reported.

According to witnesses, Kindle and several occupants got out of the car and pushed it out of the residence and down the road before abandoning it, police said.

Roark said Kindle contacted the apartment's management Thursday when he woke up, according to the report. Police said the accident was under investigation and no charges had been filed.

Kindle was suspended for the first three games of the 2007 season after a driving-while-intoxicated arrest. He recorded 10 sacks in 2008.

"Kindle made the football staff aware of what happened, and we're happy he's OK," said John Bianco, a UT football spokesman, according to the American-Statesman.

A statement from the apartment's management company estimated the damages to the exterior wall of the building at $8,700, the newspaper reported, and the wreck destroyed furniture, a computer, a desk and a cell phone in the apartment's bedroom, the resident said.

Ashley Zapata, 21, said she wasn't home at the time of the crash. According to a statement from the management company, Zapata and a roommate had been given new apartments.

Emily Dole, Zapata's roommate, told the newspaper that she returned home from work to find everything "in pieces" in Zapata's bedroom

"She would have been dead if she had been sitting at her desk," Dole said.

I'm sure his "punishment" will be a two game suspension against Louisiana-Monroe and Wyoming and he'll be on the field for the TT game.
 
Above and beyond what a judge/jury will hopefully do to him, the team should suspend him for the first month of play.

Young, dumb, ignorant and foolish.
 
Well, at least he made an attempt to do the right thing by calling the law and his team. Even though it was well after the incident.

This dude supposedly has a boat load of talent and I'd hate to see another talented kid lose everything he's work for by being a bonehead. Hopefully he can get his act together before it's too late.
 
Assuming he was drunk, he lucked out. The tenants of the building he ran into weren't home, so not injured. There were no eye witnesses to report him being drunk. He was able to leave the scene and probably called his lawyer who knew that he had an 8 hour window to sober up before he had to notify the police of the accident. He tells the police that he was texting (which is not against the law in Texas), and crashed, then felt woozy and since nobody was hurt needed to go home and lay down.

The team has stated that he wont be punished and that they are comfortable with his story.

I am not defending the guy. Just stating my point of view on it. All you can do is hope that he learns from this flier he got.

Texas law doesn't appear to cover leaving the scene of accidents resulting in damage to buildings.
According to the state's transportation code, a driver who fails to leave a note at the scene providing the name of the operator, owner of the car and circumstances of a collision with an unattended vehicle faces a Class C misdemeanor if the damage is less than $200, a Class B misdemeanor if it is more.
Roark said because Kindle hit a stationary object and did not injure anyone else, he is only required to file a report with the Texas Department of Transportation, adding he planned to file it as early as Monday.

His license should be suspended as the car is not a toy and he certainly treats it that way. If not, the school needs to do what the authorities that be do not have the backbone to do and suspend him.

But he only texts when he is on a side road, there are no other cars around, while he is only going below 35 mph, because he has the keypad memorized, only looks down for a couple of seconds, and it is no more difficult then adjusting a radio while driving. :heh:

He is lucky he did not hurt (or kill) anyone else besides himself. He has already showed poor judgment once before this most recent incident, he needs to pull the ol' head out of his fourth point of contact.
 
The ramifications for his actions will be felt on draft day. This could be the difference from top 15 to top of the 2nd round. These days more and more teams are putting more stock in getting players who can stay out of trouble and on the field.

As they should, but that does not take him off the street in the city that I live in, and the areas that I hang.

Maybe. If he puts up a HUGE double digit sack number around 15+ sacks he can go in the first. If he is near 20 he may go top 10. Remember Oakland and the Bengals are still drafting.
