The NFL is looking into whether or not a party for the pornography industry illegally used images of NFL players to promote the event in Miami last month.

NFL spokesman Brian McCarthy told ABC-7 in Chicago that the league was looking into the matter involving Exxxotica Expo 2011. An advertisement you can see here featured photos of five current NFL players – Kansas City Chiefs defensive backs Brandon Flowers and Eric Berry, Houston Texans defensive back Kareem Jackson, Oakland Raiders wide receiver Jacoby Ford and Chicago Bears safety Major Wright.The ad identified the players as hosts of the party, along with some stars from the adult entertainment world.

Also listed were three draft picks, most notably Corey Liuget of the San Diego Chargers. The draft picks, including Miami Dolphins running back Daniel Thomas and Baltimore Ravens running back Anthony Allen, were not pictured.


“The NFL office works on behalf of the clubs to protect their intellectual property rights in matters such as this,” league spokesman Brian McCarthy told the television station.


“Our legal team is reviewing the ad. In general, companies not affiliated with the NFL or its clubs may not depict a player in his uniform.”

There is nothing wrong with players hosting parties like this, but trademark issues come into play when players are shown in uniform.

I am surprised to learn that players can't be depicted in their NFL uniform without NFL consent. I wonder if any other organizations are allowed to make that IP claim, like the US military, Boy Scouts, Police departments, etc. I don't see how the NFL can make that claim unless they own the picture in question, in which case it becomes a copyright issue. If the photographer who owns the pictures sold the rights to this group to use in an ad, why should the NFL have any say over that material?

As the bolded sentence is not within quotes I am assuming this is your view rather than NFL. I would think NFL would not want to have the uniformed players in advertizing porn. Conduct detriminal to league or something?

I heard a condom company turned KJ down as he was not much good in coverage, protect defense as he kept slipping down.

I have heard that women in police departments have been terminated for "playboy" type pictures while in uniform.

Well, not that he put the flyer together....but that's obvious. You can't use company images without their consent and since it's the NoFunLeague I'm guessing this isn't on the list of approved uses.

I was in a drum corps, one that was down a few rungs on the ladder, so to speak. We had to sign every single year that once we were in uniform, our images could be used by anyone for anything related to drum corps. Basically at that point, our image was owned by someone else. That's for stupid ass DRUM CORPS. You think the NFL doesn't have something about a million times more intense?

Definitely not the kind of thing you want to see your first round investment getting into and spending his money on. But.....it's his thing....and his money....I just wish he was spending time covering receivers instead of promoting them.

This has been in effect for as long as I can remember, unless the company is an official NFL sponsor, when a player appears in the commercial they have to wear street clothes or a non any team uniforms.

MLB and the NBA also protect there brands in this manner.

Texans cornerback Kareem Jackson released the following statement: “I wanted to clarify an event that took place on May 20th at Club Play in Florida. I authorized my name to be used at that club with the understanding that it was going to be a party hosted by NFL Players. It was never explained to me or did I ever authorize my name or likeness to be associated with Exxxotica Expo 2011. I am appalled that my name and likeness were used in that capacity. In addition, I never authorized the use of my likeness or picture in my NFL uniform. I apologize to the Houston Texans, their fans and family if I caused any embarrassment. I am sincerely sorry.”

Major Wright I believe it was also spoke out against it. I believe he said he agreed to host a party, but he did not know what it was for and did not authorize his name and picture to be advertised. If this is the case, maybe it was just some really creative and suave marketing guys for the expo and some gullible players that didn't think to run it by their agents.

then again, its also possible they also just didn't realize it would turn out to be an issue and then tried to cover it up when it turned into one.

While I have never shied away from criticizing Kareem's game, I can't get worked up over this. Were there human sacrifices at this party? Did any roosters meet a premature death? No? Then what's the big deal?

I guess it would be a bad thing for the team if Kareem was suspended for a couple games ?
Nnamdi & Cromartie could probably hold down the fort for a game or two. :)

Flyers promoting a “porn star exxxtravaganza” held last month in Miami plainly infringed on NFL team trademarks and probably created image issues for the eight players named in the advertisements, but this would seem to be a scandal with the approximate shelf life of unrefrigerated dairy.

If you’re not a hysterical talk show host or a professional prude, the idea of athletes associating with women who specialize in exposed skin is not a news flash but a cliché. If some of those athletes are sufficiently dumb or inadequately diligent to allow their names to be used in the same ad that promotes an after-party for the adult expo “Exxxotica,” that’s not a crime and perhaps not even proof of a character flaw.

“I was invited to a party by a friend that occurred on May 20th at Club Play in Miami,” Chargers’ first-round draft choice Corey Liuget said Wednesday in a prepared statement. “I had no prior knowledge of this event and did not authorize the use of my name to be associated with this party. I am disappointed that my name was used and associated with this type of event and will take all actions necessary to protect my good name and character.”

Prepared statements are invariably incomplete, often misleading and generally designed for damage control rather than transparency. Yet while Wednesday’s lawyerly spin raised suspicions of real sin, the truth may not be nearly so titillating.

Club Play’s position is that the NFL players were promoted as “hosts” of a launch party for a clothing company called “Two In The Shirt” (the company’s ads feature its more provocative acronym) and not the concurrent “porn star exxxtravaganza.”

Visually, this was a distinction without much difference on the promotional flyer, in which the two events shared both space and type faces, but it was a point of emphasis in Club Play’s serpentine news release and a source of plausible deniability for the associated athletes.

“At no point was either party acting in conjunction with the other,” Club Play General Manager Lia Ames said. “The (Exxxotica) event was at a South Beach convention center and had no portion of their event on Club Play premises and no endorsement or involvement was ever given or implied by any of the players who were listed as hosts.”

That said, the ad created an impression that could be hard to erase. With photographs of five veteran players surrounding the conspicuous cleavage of model/actress Erica Mena, it was easy to confuse the two events. Official repercussions are unlikely - the NFL is in lockout, after all, and Corey Liuget is unsigned - but the players moved quickly to proclaim their innocence over appearances that screamed of naughtiness.

“I authorized my name to be used at that club with the understanding that it was going to be a party hosted by NFL players,” Houston cornerback Kareem Jackson said. “It was never explained to me nor did I ever authorize my name or likeness to be associated with Exxxotica Expo 2011. I am appalled that my name and likeness were used in that capacity.”

Chicago safety Major Wright said he “never would have given authority” for his name or likeness to be associated with the adult expo. Miami running back Daniel Thomas said he had no knowledge of the event and would “pursue all remedies available to me” to protect his name.

Though the flyer clearly runs contrary to the image the NFL strives to project, the league’s focus is on the intellectual property issues arising from the unauthorized use of photographs of five uniformed players: Jackson, Wright, Kansas City defensive backs Eric Berry and Brandon Flowers and Oakland receiver Jacoby Ford.

League officials indicated that this type of trademark infringement typically leads to a “cease-and-desist” letter, which recipients typically heed rather than risking litigation.

Exxxotica entrepreneur J. Handy, who goes by “Jerry” when he answers the phone at Philadelphia’s Victory Tradeshow Management Group, said Wednesday afternoon he had yet to receive any correspondence from the NFL. Handy hastened to point out, however, that his company was not responsible for the flyer causing all the fuss.

“It’s a relatively simple situation,” Handy said. “We have licensed our brand to 12-15 exhibitors or promoters or club owners in the same way that the NFL licenses its brand. It’s not our responsibility to police an event they’re producing.”

In return for lending out the Exxxotica name, Handy’s VIP customers were allowed access to the after-party. There were, he said, no cash considerations.

“We didn’t create the artwork for the flyer,” Handy said. “When I first learned of it, we took it off the website. We’re as third-party to it as you could possibly be.”

So, perhaps, are the players. Except, of course, for their photographs.

I don't know about a picture with Texans' uni was an appropriate thing to do but, to paticipate in porn party is nothing's wrong with that. He is young man and likes an adventure. I did crazy things when I was young too. He just likes to Kaream Jackson on ladies and that is all to it.

How could ALL these players have fallen for the same trick?

Were they present at the actual May 20th porn show event at that club? They are saying they were lending their name to a party at that club, so wouldn't you be attending the event? Did they go? If they did, what was their reaction when they arrived and found out the event was not what they understood it to be? Did they leave?

Once again: Did they even attend at all, and if they didn't attend...why would they allow their name to be associated with an event they never attended?

If I lend my name and likeness to something, it's damn sure never going to be for a party at a nightclub. I mean, these places are selling alcohol and there's sometimes a gritty and "adult-flavored" entertainment climate going on.

I just think Kareem Jackson is snake-bit. Why do these sorts of things always leak out about this guy? I'm not saying there's a perfect NFL player out there who doesn't mess up or do goofy stuff every now and then. But Kareem is a 1-year-old in the NFL and he's got chicken fighting photos and now a porn show event tacked to his name. I'm not saying he's evil, just perhaps not the sharpest tool in the Texans shed. Take a hint, Kareem: Lay low for awhile, find a safe house, sit the next couple of plays out and take a breather.

These guys either knew damn well what was going on at that club, or they very foolishly allowed a stranger to use their name and likeness for what I think should have sent red flags flying for any normal person out there in that same situation. Either way, I think they're dumbasses. LOL.

And never actually thinking about ramifications?

And where the HELL is this player's agent on these things? I'd dump KJ's ass after this latest publicity debacle. That's a liability, IMO, for an agent who is trying to make sure his client gets the most money for the best terms he can get out of each contract. And so when KJ does these dumbass things, he's affecting lots of bottom lines (not just his own).

If I were a player, I'd have my agent research and handle all requests for my name/likeness to be used. I'd know what the requesting person or entity IS and who they WERE and what they want to BE. Lots and lots of background checks and references and such. And contracts. Detailed contracts.

KJ is coming off as being a dunce, IMO. Geez, what's next? Being caught planking in the nude on top of Reliant? LOL.

I do not think the NFL is going to like that party using those images of the NFL players in their promotions. Also the players association either. I would not be surprised to see some fine come down for this. The NFL has rights to all those players images and how they are used. These were probaly used without their consent and therefore the NFL could sue them for doing that.

I believe in the saying that you become who you hang out with .....

I mean, if I was a wealthy football player, or anything, what I would want to spend my time and money on is going to **** fights in Mexico and associating my name with the porn industry .... right? Brilliant!

It is just a couple of things but, could become a trend in KJ's life and such trends probably show such players end up broke at the end of their careers and their "friends" are gone.
