I think you have to be a certain distance away from the event and/or have some kind of license.

Its not illegal in the state of Texas. On the flip side keep in mind the "scalper" is takign a risk in buying tickets that he/she may not be able to unload and take bath on it. I still remember back in 96' opening dy going to the Astrodome and seeing the worlds worst scalper tryong to scalp tickets to agame that only 20k attended (Chiefs Oilers).
