Just horrible news out of New Orleans late Saturday night. Former New Orleans Saints Will Smith was shot to death and his wife was wounded. Reports are suspects are in custody.

Police say Will Smith’s death appears to be a case of road rage

Former Saints defensive end Will Smith was shot and killed on Saturday night in what police say appears to be a road rage incident.

“It appears that it could possibly have been road rage,” New Orleans Police Officer Juan D. Barnes Sr. said.

Smith was driving and his wife was in the passenger seat when their car was hit by a Hummer, causing Smith’s car to hit a third vehicle.

“The male victim and the driver of the Hummer exchanged words at which time the driver of the Hummer produced a handgun and shot the male victim multiple times and his 34-year-old wife twice in the right leg,” police said in a statement.

The 30-year-old Hummer driver is in police custody.

Smith’s wife was taken to a nearby hospital for treatment for her leg injuries. They have two sons and a daughter.

Update (12:54 p.m.): The New Orleans Advocate reports Will Smith ate dinner with former New Orleans police captain Billy Ceravolo shortly before being murdered. Ceravolo was a defendant in a high-profile lawsuit filed by Cardell Hayes over the shooting death of Hayes’s father in 2005. The Advocate reports Ceravolo, who was personal friends of both Smith and Pierre Thomas, was not at the scene of the shooting. The original story continues below.

Sounding almost more like the rear ending was part of a premeditated murder.

Exactly. Maybe a case of mistaken identity. Maybe he'd never seen the policeman before, and someone pointed him out at the table, but the murderer mistook which guy he was talking about.

Cardell Hayes’ lawyer claims his client “was not the aggressor”

Like so many other crimes, the death of former Saints defensive end Will Smith seems on the surface to be a case of murder. But Cardell Hayes, like every other person facing criminal charges in the American criminal justice system, is entitled to a defense. And his lawyer, John Fuller, already has begun the process of trying to lay the foundation for claiming, eventually, that Hayes acted in self defense.

“My client is of the opinion that toxicology should be conducted of all the parties that were involved in this, and that will shed some light on the behavior of some of the participants,” attorney John Fuller told a group of reporters on Sunday, via a video posted by the New Orleans Times-Picayune.

“We know Will Smith was coming from a restaurant,” a reporter asked Fuller. “Does that have something to do with that? Is that what you’re saying?”

“Quite possibly,” Fuller said.

“Do you think Will Smith or somebody else may have been intoxicated in this event?”

“Well, I know that there were parties that were intoxicated or under the influence of some type of mind-altering substance, based on appearances,” Fuller said. “We don’t know that for sure, but we have a strong suspicion that that was the case.”

“Did anyone else have a gun other than your client?”

“It’s possible that one of the parties involved had a gun,” Fuller said.

“Did Mr. Hayes say he feared for his life?”

“Well, I don’t want to go into details what my client said, but I’ll say this,” Fuller said. “The reports that we’ve heard so far that were on television and various news outlets were not consistent with everything that happened, and I can tell you that my client was not the aggressor in terms of the behavior that happened after the accident.”

It’s one thing for Fuller to claim it; it’s quite another for him to eventually prove it. However, it’s already clear that Cardell Hayes will, through John Fuller, be attempting to minimize his ultimate criminal liability.

NEW ORLEANS (AP) — Former New Orleans Saints player Will Smith was shot in the back and side, according to a warrant read in court Sunday night before a magistrate set a $1 million bond for the man accused of killing him.

Police said Smith, 34, was killed in a case of road rage by a man who had rear-ended his car. They arrested Cardell Hayes, 28, on a charge of second-degree murder. Prosecutors have 60 days to decide whether to bring that charge against Hayes.

Hayes' Humvee H2 rear-ended Smith's Mercedes G63 around 11:30 p.m. Saturday in the upscale Lower Garden District, pushing it into a Chevrolet Impala driven by two of Smith's acquaintances. The two argued, and Hayes shot both Smith and Smith's wife, Racquel, police said. She was taken to a hospital with a leg wound.

Defense attorney John Fuller asked for low bond Sunday night, noting that Hayes had waited for police, owns a towing business and is raising his 5-year-old son.

Magistrate Brigid Collins said she understood but, according to the warrant, "I've also got a gentleman who was shot in the back."

Smith and his wife, who have three children, had been at the French Quarter festival, which features local music and food, in the hours before the shooting. He posted a photo of himself and his wife on Twitter and Instagram with the caption: "Having a blast at the #fqf2016 @ French Quarter Fest."

Hayes and Smith didn't know each other, Fuller said. But, he said outside the courthouse, the accident that police said touched off the deadly confrontation was the second within moments.

He said Hayes ran into the back of Smith's Mercedes while following a hit-and-run driver who had rear-ended his Humvee and sped off. Fuller wouldn't say whether Hayes identified the Mercedes as that vehicle.


Hayes is not guilty of murder, and the story is more complex than the police account, Fuller said after the hearing. He said Hayes called 911 after he was hit and convinced a witness who was about to leave to remain and talk to police.

Police spokesman Tyler Gamble told The Associated Press in an email Sunday that he had no immediate information about the witness or the 911 call.

Online court records show Hayes pleaded guilty in 2014 to one count each of possessing an illegal weapon and possessing drug paraphernalia.

The gun he had Sunday was legal, Fuller said, noting that police didn't accuse him of any weapons charge. Gamble said the gun hadn't been reported stolen, but tracing its actual history takes more time.

Hayes sued the New Orleans Police Department and six officers after police killed his father in 2005. Police settled the lawsuit in 2011. The settlement is confidential, said attorney Ike Spears, who represented Hayes in that lawsuit.

Smith was beloved by fans for his role in New Orleans' 2009 Super Bowl championship, though the defensive captain also was at the center of the NFL's bounty probe in 2012, the last year he played in an NFL regular season game.

The league concluded that Smith and fellow defensive captain Jonathan Vilma helped run a locker-room pool that paid cash bonuses for heavy and even injurious hits.

Smith successfully appealed a four-game suspension, though coach Sean Payton was suspended the entire 2012 season.

A year earlier, however, Smith served a two-game suspension for using a weight-loss product that included a diuretic banned by the league for masking steroid use.

Smith, a native of Queens, New York, played for Ohio State's 2002 national championship team and graduated in 2005 with a degree in criminology.

New Orleans chose him in the first round of the 2004 draft. He led the Saints with a career-high 13 sacks in 2009. Smith's 67 ½ career sacks rank fourth in Saints history. The New Orleans Saints Hall of Fame says Smith had been unanimously voted into the hall last month.

Off the field, Smith established a foundation "to motivate, educate and provide opportunities for women and children."

The Smith family said in a statement Sunday that they were thankful for the outpouring of support but requested privacy as they grieve.
 
This looks like simple road rage to me. It got out of hand, dude came out shooting. He didn't try to get away. He stayed & tried to plead his case.

I don't know what to make of all this.

It just seems odd that this guy that shot Smith had a lawsuit against the police Dept and he's kind of a known guy around there. Tyran Mathieu said he knows the guy and he's been a "hater for years" or something like that.

It just seems odd. The guy supposedly owns his own tow truck company. He's saying someone hit him first.

I dunno. Seems like there could have been some other motives around this.

All I'm going to say is: having read the excerpt you posted, all I kept thinking was this happened in Louisiana. There are few places that rival Chicago in terms of how they handle stuff. Louisiana is one.

Any time a celeb is a victim of something such as getting rear ended then shot. I cant help but think it started as intent of robbery that escalated quickly.

Whatever the reason isn't so important as the outcome results the same...... senseless death and suffering.
 
In the video this morning it showed Smith hitting him first then running.

Hit and run can be a felony in some circumstances.

Maybe he was drinking and didn't want to get busted? Don't know.

Probably wished he would have just stopped before all was said and done...

Cops Say A Loaded Gun Was Found Inside Will Smith’s Mercedes

3 days later and the NFL community is still reeling from the shocking news that former New Orleans Saints defensive end Will Smith was murdered in cold blood as he sat in his car after a fender bender accident.

There was a witness at the scene right after it happened that stated on camera Will Smith told his killer that he had a gun. No gun was found initially on Smith until Tuesday when they got a search warrant to check his car.

TMZ has the details:

“The New Orleans PD says a fully loaded 9mm handgun was recovered from Will Smith‘s car after he was fatally shot.


Cops made the announcement Tuesday afternoon — after finally executing a search warrant that allowed them to search Smith’s Mercedes.

The discovery will undoubtedly help the defense — which is claiming Cardell Hayes felt threatened by Smith at the time of the shooting.

Cops say they’re still investigating and interviewing witnesses — including Smith’s wife and the 2 additional passengers in Smith’s car.”

It’s officially much easier to predict the football future of Johnny Manziel than it is to explain his present living arrangements.

Per a source with knowledge of the situation, and contrary to a report from ESPN, Manziel is not currently living with suspended Browns receiver Josh Gordon. ESPN reported on the existence of a Manziel-Gordon apartment-sharing situation on Sunset Boulevard in Los Angeles after Manziel said (incorrectly) that he is living with Broncos linebacker Von Miller.

Miller has denied living with Manziel, and Manziel has since apologized to Miller for dragging him into a bizarre misstatement at best and a flat-out lie at worst from Manziel.

It helps neither Manziel nor Gordon to be tied together at this point in their careers. Gordon’s request for reinstatement to the NFL has been denied, and he can’t apply for reinstatement until August 1. Manziel remains unsigned and, but for Miller’s desire to bring him to Denver, unwanted.
 
From the video footage I thought it was strange that the hummer stop suddenly in the middle of the street, with no traffic sign or a pedestrian crossing anywhere, almost looks like he was baiting an accident, hmmm. Then a audio footage and a witness emerged saying that Smith and Hayes argued on the street and that one of the men, Cardell stated he has a gun and then Smith said the same thing.

I thought I play couch detective on this one:

Cardell Hayes spotted Billy Ceravolo that night, whom was one of the officers that shot and killed Cardell's father in 2006, and went into a murderous plotting rage. After Ceravolo and Smith finished dinner, Hayes followed Smith Mercedes thinking Ceravolo is riding along. So he sped up ahead and stopped short that causes the fender bender. But Smith doesn't stop. So we have a brief chase. When the hummer catches up to the Mercedes and get into a second fender bender, this is where the real crime takes place. After the two men emerges from their vehicles, Hayes baited Smith again, this time saying he has a gun, hoping Smith would throw the same caution into the wind, which he would use as his defense. Then as Hayes watches Smith walked back to his Mercedes, bang bang bang. Smith is shot on his back and torso as reported. Hayes then goes after his main target which was Billy Ceravolo. He fires hastily in the passenger area but stopped after realizing it wasn't Ceravolo.

From what I have seen Smith never really (legally) threatened him with a gun. Saying you have one isn't the same as pulling one.

But you're correct, old saying - God made man, but Samuel Colt made them equal.

Smith may have told Hayes that he wasn't the one to hit his car and that he was going to get his gun out of his vehicle. Hayes retreats to his vehicle to get his weapon for protection. When Hayes turns around, Smith is just finishing reaching in his vehicle for his weapon. Hayes unloads into Smith and the vehicle, striking Smith and his wife.

So many ways this thing could have gone.

I don't see how man regardless of size and Samuel Colt are equal. It seems to me that Samuel Colt would always have the advantage over an unarmed man.
 
The point of the quote is everyone could carry a Colt and then size didn't matter (in context).
Oh, I will read it again and perhaps it will sink in eventually. However, at my age I don't know if I will put too much thought into it though.

None, if the guy has the gun in his hand. But if he's threatening that he has a gun in his car nearby, I'm probably going to give serious thought to preventing him from retrieving that gun.
 
Family attorney claims deliberate, premeditated killing of Will Smith

With the lawyer representing Cardell Hayes trying to create the impression that Hayes killed former Saints defensive end Will Smith in self defense, the lawyer representing Smith’s family tells a much different story.

During a Wednesday press conference with key aspects summarized by Evan Woodbery of the New Orleans Times Picayune, attorney Peter Thomson (pictured) provided chilling details regarding the incident, in an effort to rebut the “lies and factual distortions of what occurred that night that have been perpetuated by the killer.”

Thomson said that the incident began when the Hummer driven by Hayes abruptly stopped in front of their Mercedes SUV. Will and Racquel Smith, concerned for their safety, saw no damage to the Hummer. Will Smith drove away.

Not long after that, the Hummer “violently rammed” into the back of the Mercedes, shattering the rear window of the vehicle. Will Smith emerged from the vehicle, and he saw Hayes approaching. Hayes was “enraged, yelling and cursing.”

The situation then seemed to calm down. Smith walked back to the SUV, but Hayes followed him. Hayes suddenly fired two shots, both of which hit Racquel in the legs. Then, Hayes fired six to eight shots into Will Smith’s back.

“At no time during this event did Will Smith ever brandish or carry on his person a firearm,” Thomson said, in reference to the fact that a loaded gun was found in the Mercedes SUV. “That firearm was in the vehicle; it was never taken out, never brandished, never fired.”

Thomson added that Smith was licensed to carry the weapon in Louisiana.

Racquel Smith was shot in each leg; one bullet fractured her right femur. Thomson said that Racquel Smith is expected to make a full recovery. Thomson also believes Racquel Smith was deliberately targeted, not accidentally shot.

The conflicting versions, which have included a lawyer for a passenger in the car driven by Hayes calling it a “justifiable homicide,” sets the stage for a messy, contentious trial with the two theories at direct odds and a judge and a jury charged with sorting it all out.
 
It makes no sense. All because of road rage? Why are people so stubborn behind the wheel? Who cares and move on! More senseless violence that could have been avoided. What could Will Smith have said to the guy to make him pull out his gun and start shooting? Hopefully Will Smith's wife makes a full recovery as expected. I'd imagine she'll be the key witness? Her word against that other guy's passenger.

What a waste of ammo. My Sig 220 West German holds less but I would have five left if I am in that circumstance. Two people ... only two were needed.
 
The gunman accused of murdering ex-NFL star Will Smith allegedly stood over the football player's dead body and yelled at him as his wife crawled away, cowering in pain.

A lawyer for the former Saints defensive end's family also revealed that Racquel Smith pleaded with suspect Cardell Hayes to leave them alone as they had children - before he shot her husband eight times.

His heartbroken relatives wanted the world to know he was not the aggressor in the road rage incident and insists the firearm Smith carried was stashed away in the glove box of his Mercedes.

While Smith's lawyer admits the footballer was in possession of a handgun, he said the fully-loaded weapon remained locked inside a compartment in his car throughout the exchange.

Whether the gun was locked in the glove box is already known by the cops. The fact they got a warrant points towards yes.

I know the laws vary in different states, but I believe that threat constitutes assault in Louisiana. That doesn't justify the actions of the shooter, but it does call BS on some of the narrative being pushed by Will Smith sympathizers.

And Sean Payton probably needs to come out and admit he was a dumbass that jumped the gun with his comments.

What I have seen reported is the statement "I have a gun." That would not generally suffice as a threat for assault. "I'm gonna get my gun and shoot you" - you're in trouble. But the timing is important as well - did the statement come before or after the shooter brandished his firearm?

What about if he said something like "don't make me go get my gun" in the heated exchange but Hayes did not reveal that he had a gun at that time?

That's probably getting to a jury but he could still attempt to sell it as a defensive statement, in effect 'I will defend myself (and family) with everything I've got.'

There is supposed to be an unjustified threat for assault.
 
From all the current reports, I don't really see what Smith could have said that led to and justified a "self defense" shooting where the shooter shot Smith's wife in both legs and then shot Smith 7 times in the back. Witness reports also stating that the shooter then stood over Smith's dead body afterward. Sorry, I don't buy whatever the defense is selling.

No, I think it's pretty clear that guy is going to jail. All I'm saying is getting out of your car after an accident and telling someone to "get out of here, I have a gun" (pretty close to what was reported) doesn't render you blameless in the situation.

Okay I quite agree. From what I've read, Smith was at fault in the fender bender and then tried to flee. He was also apparently a bit inebriated.
