I'm ignorant on this kind of stuff and maybe it's not this cut and dry but my main question is who pays the police department? Notre Dame or the state of Indiana?
Because if it's Notre Dame then I would think that they are correct in their interpretation. If the state does then I don't see how ND could argue that it is not a public agency.

It's more complex than who pays. They have arrest authority and send folks into the criminal system.

Haven't examined the state law but most likely they'll be held subject to the law if their best argument is we're private.
