I know of a number of situations where people are stopped, think they are just being warned and don't understand that they are being asked to stay to get ticketed, drive off, and then the police go after them. "Evading arrest" makes it sound worse than what it really is:

§ 38.04. EVADING ARREST OR DETENTION. (a) A person
commits an offense if he intentionally flees from a person he knows
is a peace officer attempting lawfully to arrest or detain him.
(b) An offense under this section is a Class B misdemeanor,
except that the offense is:
(1) a state jail felony if the actor uses a vehicle
while the actor is in flight and the actor has not been previously
convicted under this section;

The law requires intent to flee. If he didn't understand he was supposed to wait there, that it was a misunderstanding then it won't stick. Happened to a friend of mine that way.

This is too weird to be just as it is stated in the paper--I think there is more to it--but that is just my spider sense talking and nothing else.
 
I don't know TC, though it does seem like a really bad decision if it was on purpose. I guess we'll see.

The Cowboys obsession is troubling. As a 100% die hard Cowboys fan for life, I wish no ill will against the Texans or any other team and get no personal satisfaction if a team member has a brush with the law or any other negative situation. Folks, stuff happens, you can't control it, and life should go on for you as a fan.
 
We have just gotten into this game. We will have to do more than 1 arrest per year to be significant players on the police blotter.
I know, but I just find it ironic. People are complaining saying we should pick up some trouble-makers or not care about character, and only worry about talent. However, a lot of us don't agree with this arrest and don't like seeing our team's players in trouble. It's actually one of the reasons why the Texans are my team, we have character and values.

I should of edited the quote, I was more so agreeing with the principle of the quote, not necessarily the teams mentioned. I really don't have that much hate for the Cowboys (although I did have a few names come to mind).

Pitts will claim that it was a misunderstanding and that he thought he were ok to drive away. Once he realized that this was not the case (sirens and blinking lights do that to you) he immediately stopped his vehicle. He'll get a fine and be out of there.

The Texans are gathering information and will likely release a statement today. I suggest holding off judging until we know what the facts are.

But what I do know is that "felony evading arrest" sounds really really bad but doesn't necessarily mean a huge high speed police chase. I can think of at least 4 cases that my husband has dealt with involving HPD over the years where the person misunderstood the officer and didn't realize that they were not free to go. Then they drove off, and the police went after them, then they pulled over. No intent to flee a known detention, no case.

Sometimes with stuff that seems totally stupid for a guy to do (run away from a silly ticket), there is more to it. We have only heard the police version of the facts.

Police officers aren't interested in whatever your story is. Like "hey I didn't realize I was being ticketed. You just left." They are interested in doing their job and not getting killed doing their job. So misunderstandings happen all the time.
 
I'm interested to know the story too TC. A month ago I went golfing with my Brother in laws. On the way back there was an accident at 288 right before downtown. I was getting on the entrance ramp pretty quickly..it passed right by the accident. the car in front of me stopped suddenly and I went into the shoulder to go around and avoid him. There were cops everywhere. Some cop with an attitude pulled me over and started screaming at me about "who do I think I am", "do you think you are better than everyone else," "you are going to sit here on the shoulder until I tell you you can leave," "stop talking, your lying," "how do you like my porno stache"(ok, made up). I tried talking..didn't work. So we sat. He rode off 10 minutes late...while my car made people even slow down more. Another cop made me wait longer..even though the other guy told me I could leave when he was "out of sight." Eventually I got to leave....but I hate cops more than when I hated cops before. It was a complete power trip on something I just made a mistake on because of traffic. I didn't get mouthy besides trying to explain myself. I didn't do something dumb like pull the "I'm an attorney" b.s. they hate so much. So I can see the mix ups. My friends at the DAs office probably would give me the needle though:shades:

I would have thought the officer would have said something like "Where the hell do you think you are going?" Pitts would reply "Oh, you meant for me to stay there and get a ticket? Sorry. I misunderstood. I'll take the ticket now."

Must have been a little more to it at least in the officer's mind. I am thinking Chester looked over his shoulder and saw something big trying to run over him and thought "There's that darn Ron Dayne again. Guess I better pull over and get out of the way."
