A Houston Texans player is under investigation for possible domestic battery. The Houston police department Friday confirmed that Texans lineman Fred Weary is under investigation for an incident that occurred at a local swingers bar.

In the police report, witnesses told HPD that for some unknown reason Weary started a fight inside the club breaking tables, chairs and glasses. When people tried to stop him, the report states pushed them around as well.

The big Texans lineman allegedly threw a drink on a female family member and then assaulted her.

Great, this should make for an interesting offseason for the linemen.
 
Makes me wonder if he really was in trouble last year and was trying to talk his way out of it.

I'm a little confused by the report ? It says he is now "in the spotlight again".
I'm thinking that in reference to the incident origionally reported at the "Secrets" establishment which was 2 weeks ago, but seems a bit unclear ?
At any rate even the Texans, even as closely as they monitor they're players and these character issues, will have a few bumps in the road along the way.

Investigative sources told 11 News that female was Weary's wife. According to the report, they were at the club with several others for a bachelorette and bachelor party.


Davis Stevenson, who works at the club, was the main complainant on the report. Weary has not been charged or arrested in relation to this most recent incident.

Here's my sum up:

Guard Fred Weary Investigated by Police

It is unusual for the police to be called out somewhere for a fight and NOT have charges filed on someone. Usually the police arrest people and then let the court system figure stuff out. Something doesn't smell right. Either the evidence was really not good at all, or he is getting special treatment. No way to tell.

If Weary paid the swingers club owner for the damages, then there is no motive for him to prosecute. However HPD is still investigating him for "assaulting" his wife. And as the Warren Moon case showed, the state can still prosecute without the wife's cooperation.

Yeah, but in most circumstances like this, they IMMEDIATELY arrest the husband, then let the legal system sort it out. They don't think about it and investigate it later.

If a husband and wife fight, and the police get called, usually the husband is the one that gets arrested (unless he looks like he got the worst of it). Even if the case is BS. Then it goes through the legal system, lots of money is spent on lawyering, and then if the case is total BS it gets dismissed.

So, either a. the evidence was really really really weak or b. he is getting special treatment.
 
I haven't spoken to anyone yet, but my guess is the evidence is really, really weak.

Editorial aside: Weary's an intriguing character. On the one hand, everything I know or have heard points to the kind of guy who wouldn't be investigated for assaulting his wife and wouldn't be tasered. On the other hand, these events have transpired. I guess it's true that you never really know anybody (probably an ironic point on a message board).

Weary and the wife go to the swingers club for a party . Weary has no idea where's he at ... guy makes a pass at Weary's wife , she thinks it's all in fun , the guy thinks it's real because it's a swingers club . Weary takes exception because guy's hitting on his wife , wife gets mad ... says he overreacting ... did I mention there was probably a lot of drinking involved , anyway she gets mad and gets on fred even though fred's perception was right , the guy was trying to score .

That would be my hunch as to what happened .... there's a moral in there somewhere .
 
Remember back when he got tasered and said he would go after HPD if he did not receive a public apology (which he never did receive)? Assume he wanted to go through with the lawsuit. How does this affect that lawsuit?

Yep, that's probably the closest story to the truth.

The moral is don't try to pick up Fred Weary's wife in a swingers bar. You'd think that one glance over at that big, hulking dude giving you the evil eye would give you pause, but then again, probably alcohol involved so signals were obviously missed.

donno..but I read that HPD reviewed their taser policy shortly after the Weary incident. I had an article parked from the chronicle but it's now in their archives.

How about Weary's wife dances too friendly with someone. Weary comes unglued at the wife, and starts trashing the place in the process?

Why is Weary going to Secrets for a bachelor party anyway? Most people go to topless clubs for such events, not to "swinger" clubs.

We don't know all the facts.

I will say that having a combined bachelor/bachelorette party is kind of a dicey thing. I had a co-ed bachelorette party, and well, it was totally fun but there were some unusual liquor induced stuff that happened by the end of the evening. (Not to me though).
 
Well if it doesn't work out for Weary on this one, we can always introduce this "Swinger" to our friend who owns the "Rape Stand"...<dang, my sick twisted mind makes yet another perverse connection> :)
