Time Warner threatens court action over NFL channel

WASHINGTON (Reuters) - Time Warner Cable has threatened to go to court to overturn a decision forcing the No. 2 U.S. cable company to reinstate the NFL Network on some of its systems, according to a filing obtained on Monday.

Time Warner, a unit of Time Warner Inc. (TWX.N: Quote, Profile, Research), was ordered last week by the Federal Communications Commission to restore the channel on cable systems it acquired as part of its purchase of bankrupt Adelphia Communications Corp.

The NFL Network had accused the cable operator of dropping the channel in violation of rules that require 30 days notice for doing so and asked the agency to intervene. The FCC ordered Time Warner to restore the channel, just days before the NFL preseason gets under way.

I don't get why Time Warner wouldn't want to have NFL network..something I missed over the months? (is time warner making them PPV?)

All that would do IMO was get people to get the dishnetwork to see NFL network

Time Warner Cable has said the NFL Network wants a 350 percent increase over the rate Adelphia was paying, or approximately $100 million.

A spokesman for the channel disputed that rate and said the fight was about whether it would be relegated to a sports package or available more broadly.

"No other provider in the country carries us on a sports tier and we refuse to have Time Warner do so," said NFL Network spokesman Seth Palansky. "We have not had any subsequent conversations but would hope that we can soon."

Time Warner vs NFL , my money is on the NFL! Memo to Time Warner do not mess with America's pastime!

I don't get it either. Have they ever given a reason for not having it? It seems to be that they're just being stubborn.

Based on what little I have read on it, looks like TWC wants to put it in a sports package with other channels, probably so they can charge more for it and USUALLY NFL network isn't an up charge(not sure if that holds true all over) and they (NFL) may not like being just another channel. That may be why they are fighting.

This kinda reminds me of when TWC was fighting it out with SBC....don't really remember why. I remember both sides were trying to enlist public support.

I don't think the public could have cared less.

From a PR standpoint, my money's on the NFL. A lot more people think that they are getting ripped off by TWC than the NFL.

Eh, I use to have direcTv and I was simply not impressed with NFL Network. It's definitely not good enough for me to drop all the cash required to watch HD programs on Dish. TWC's HD lineup is superior, and they do not make you buy the equipment. Contrary to what many say on here my experiences with Time Warner have been very pleasant, and the only time service dropped was during Rita.

I suppose if I ever move out of the Houston market I will get Dish so I can subscribe to Sunday Ticket. I can certainly understand switching for that, especially if you dont live in your team's city.

I think the NFL is being a bully in this matter. It should be up to Time Warner when and how a station will be added to the mix. I don't like businesses that try to impose their will onto other businesses.

Having said that, TW is being stupid for not putting it on the basic tier. But, it's an issue between TW and its customers, not TW and the NFL. I disagree with the person who said NFL network was no good. I enjoy it very much on DirecTV. And remember, for the first time, regular season NFL games will be on that channel this season. Basically, this is a "Vote with your feet" deal. If you think TW should put it on the basic tier, tell them so. If they don't change, cancel them, and tell them why. Call Dish or DirecTV and you will have you NFL network in a matter of a couple days. The consumer is king.

The Dish Network has a much better lineup of HD programming. The NFL Network on Dish is both in SD and HD. It's significantly cheaper for me to have Dish over TWC.

If you want Sunday Ticket, you'll need DirecT, and not Dish... at least for a few more years.

While I agree with the basic tenets of the post, I believe that the producer of the product has the right to say how a product that has intelectual property rights associated with it, will used/displayed etc. in order to maintain proper branding, integrety and value. The value of the product is often times a precieved value and to diminish that is to diminish the ability to capitalise on what has been created.

Exactly. For Example, Harley Davidson Dealerships are individually owned... However, they will not sell the Harley Product in a way that HD doesn't approve. The NFL Network has every right in determining the usage of its product. TWC is just a reseller.
