PHILADELPHIA -- Eagles wide receiver Jabar Gaffney was arrested and charged with unlawful possession of a handgun following a traffic stop last month, county prosecutors said Friday.
Gaffney had a permit to carry the weapon in Texas, but not in New Jersey, Camden County prosecutors said. The charge carries a maximum five-year sentence but most first-time offenders get no jail time.

Gaffney, 25, was stopped on June 20 by police for driving erratically on the Walt Whitman Bridge, which connects Philadelphia and New Jersey. As Gaffney was reaching into the glove compartment, the officer saw the handgun, a loaded .380 semiautomatic that was registered to another person riding in the car.

I suppose no one on this board has ever let a license expire and procrastinated renewal or moved to another state and procrastinated getting a new license in that state. Moreover, I am sure there is no one on this board who would do anything to protect the 2nd Amendment. Much ado about nothing.

I know that the probability of him pulling time or anything more than a slap on the wrist is not high, but IMO this is just a stupid thing to do. Gun licensing laws are typically very clear and violation is an automatic arrest. Further, as a celebrity or someone with a lot of money who stood to either be targeted or even potentially extorted by corrupt police/officials, I would make it a point to ensure that my license is up to date and correct. I have several guns and have made it a point to ensure that my use/possession has remained entirely lawful. IMO there's just not a good excuse to wager your freedom and criminal record on keeping a piece with you, but without knowing the specifics of Gaffney's incident, I'll not bother commenting further. Just hate to read about him or anyone really who is probably a good citizen who just should have known better.

I would agree with your take, but the gun was not registered to Gaffney but to someone else in the vehicle.

It's one thing to be in your car, you just moved from another state you are licensed to carry a gun, and forget to remove the gun from your vehicle. That is fair enough, but a bit generous.

This was someone else's gun, which means it was probably put in the vehicle recently. Who is this person? Personally, I am not going to ride around with someone and their gun that I don't know very well.

If it was his gun, I may be able to buy it was an innocent mistake that he forgot about it or whatever. It's not his gun though, so there is some reason why it was there and who is this person?

That fact alone makes me suspicious of an innocent mistake theory.

I always get my state inspecion sticker renewed (no matter how much it annoys me) because they'd throw me under the jail .... but then again I'm no big deal .... I've never owned a handgun .....

I once lived for a year in one state with expired license plates from another state... and without switching my driver's license over, either. Then I moved to another state and got everything squared away... and then moved back to the original state after a year and a half.

EXACTLY! I agree 100%. I have a license to carry in one of the toughest states to get one....California. I am very careful when it comes to my handgun. Knowing the hoops and jumps that I had to go through to get the license would prompt me to take care of business immediately after moving. Also, the law is very strict on Conceal Carry violations.
Again, this handgun did not belong to him. What was it doing in his glove compartment? It didn't fall out of the sky and land there.
 
I don't really know much about gun law, so please excuse my ignorance.

If the gun was registered to another person who was in the car, why did Gaff get arrested and charged? The guy who owns the gun was there? If anyone should have gotten charged, wouldn't it have been the owner since it was his?

Note: Effective immediately, Governor Perry has issued a proclamation that allows persons with concealed handgun licenses from New Jersey to legally carry in Texas. New Jersey license holders will be required to follow Texas law while carrying in this state. This proclamation is unilateral and is not a reciprocal agreement. Texas concealed handgun license holders will not be allowed to carry in New Jersey.

Not pounding on Gaff (who I'm still sorry to see gone), but this isn't an "oops I forgot" sort of thing up North. He hasn't gotten licensed, and there isn't any leeway just because he had one down here. That's not even taking into account that it's someone ELSE's gun altogether. :brickwall
