They have done a story on congressional hearings on HGH and used a picture of Cushing as the cover for their video. That is damn close to slanderous. Florio should know better.

He tested positive for hcg. It isn't a performance enhancer but is banned as being an adjunct used by people after a steroids regimen to restore testosterone production.

I am surprised Florio did this. It basically paints Cushing as an hgh user and showed him in uniform in an NFL story. Making a false statement about someone's profession is very dangerous. In ordinary libel/slander you have to show the false statement was made with malice. Statements about a person's profession are known as libel/slander per se and malice does not have to be shown.

Isn't Florio the guy that was parading around to every radio station he could before the season, including ones here in Houston, to declare that the Titans were going to win the South and the Texans were going to miss the playoffs because "more can go wrong in Houston than in Tennessee" LOL!!!!

No, it is what it is.. Florio is the biggest Texans hater out there. Have you heard any of his interviews on our local stations? It all started when he proclaimed we needed to sign Farve.. he cried when we turned a cold shoulder, called out Kubiak and the FO when we didn't, and then he did the same when Peyton was up. His own site did a power poll and he was the lone guy who didn't pick us.. and I have no doubt it goes back to the Farve fodder.

This has absolutely NOTHING to do with Cushing.. his transgressions happened years ago, he never even tested positive for HGH, and he isn't even playing right now. This is strickly about Florio, his ego (big head) and his disdain for our team. Cushing was just a convienent name that supported his butt hurt Texans agenda. The guy needs to grow the hell up.
 
Two actually, if you watch the video they mention about players not telling the truth to congress like Roger Clemens. Which he was found not guilty of lying under oath.

You're right about the Favre/Manning angle. Florio has no respect for Schaub. But, he went heavy on Cushing at the time of his suspension, so he's being consistent (if not accurate).

I read PFT regularly and have since the Texans came into existence. They're newsbreakers who aren't afraid to call out anyone. Doesn't mean they're right all of the time, or even most of the time. But PFT is willing to tell it like it is (or what they think it is). Sort of a 21st century cyber-Cosell.

I read them a lot too, mainly because most any breaking story they will have something about.

But on the bolded statement... I've felt for awhile that PFT is willing to tell it however will play to the largest outraged segment of the public and garner page hits. Some issues it seems like they pander to initial widespread outrage, and then when the public moves on they switch and pander to the fan base most affected by the issue. The ones who will keep clicking on the topic.

For the record, even the most sure fired slander suit will be automatically dismissed in court if the statement is proven to be true. Distinguishing HCG as a drug that isn't technically a performance enhancer is an angle that could be argued by premier lawyers but I personally wouldn't waste the time and costly resources in a likely dismissal such as this.

I dont really care how they tarnish the guy though i'd hope he would pursue legal action. To my knowledge, he's the only guy who ever won rookie of the year twice. Screw 'em @ ptf.
 
If Cushing used PED's, the timeframe of the cycle would date their use during the combine. Zero evidence exists that Cushing used PED's while playing in the NFL.
 
If I recall correctly, the 2 biggest knocks on cushing comming into the draft were that he was injury prone and some believed he was on the juice.

I actually wanted Rey maualuga more then him or mathews. Wrong again.

A former direct report of mine (who use to oversee/adminster/grade the contract that I performed for facility management for his company, he was later laid off and hired by my company) is telling, or lets say I have confirmation that he has at least told one vendor that I was fired from my last job. I was not, I was laid off because my position was eliminated. Anyway, by telling folks I was fired for cause is a huge lie and could affect my chance at future employments with some of these vendor companies/contractors.

Do I have any kind of case? All I want is him to stop running his mouth. I thought about sending a nicely crafted email to his HR manager as I have a good relationship with her. Thoughts?
