You are correct, but whether the party can be considered a commercial use is largely going to depend on the policy language and definitions contained. I am telling that the insurance company policy is likely hundreds of pages with carefully drafted exclusions for exactly this kind of circumstance.

Such a shame that something so tragic could occur and all people want to talk about is whether or not there might be a lawsuit, its a shame that society has degraded to the point that human life is less important than money. Where theres blame, theres a claim and all that.

RIP to the victim.

I will take this one since I started it. To defend myself, when someone is dead people usually look for a reason and blame. I don't think it means that the persons life is worth less than money. My first thought on the entire situation was fear it was his kid.

I know Arian's situation was just a hamstring, but I think the mind set you are speaking about is what Arian was talking about.

It was a family friend. I expect this to bother him for some time.

I don't see anything wrong with it. If it was the Saturday night before the game then yes but I think it's ok if he wanted to have a pool party a week before the season. You gotta be able to let off a little steam somehow, someway. Especially after a month of practices in 100 degree heat.

Repped. It's all fine and dandy that we are obsessed with the Texans, but the line has to be drawn somewhere.

The "throw-everything-against-the-wall-and-see-what-sticks" approach is branded into the mind of every lawyer who attends law school.

For the non-barrister crowd, you have to bring all causes of action at one time or risk waiving them. This is usually why when people's lawsuits go public, they usually sound ridiculous because they include every possible cause of action they could potentially sue the defendant for. If the attorney doesn't bring all possible causes of action, they risk disciplinary action and could be disbarred.

Sorry TC, not trying to step on your toes...I'm just trying to put some dispel some hatred for attorneys with some insight. Everyone here knows you are the legal authority here.

From the Chronicle:

Quote:
An autopsy was completed Monday on a man found in a Houston
Texans football player's pool after a Saturday night party, but the cause of death still is pending, officials said.

Engram Lamar Crenshaw, 37, of Katy, was discovered in Antonio Smith's pool Sunday morning by one of the two dozen house guests who had slept at Smith's $1 million, 5-acre estate in Richmond.

Dr. Harminder Narula with the Galveston County Medical Examiner's office, who completed the autopsy, said the cause of death is pending a toxicology report. Narula said discussing a preliminary cause of death would be speculation.

The toxicology report is expected to take several weeks

The Texans, in a statement issued Sunday, said the team was "gathering facts." The organization declined further comment on Monday.

this is one of those things that can happen to anyone... was Antonio wrong by throwing a party. absolutely not! I think people tend to forget that NFL players are just like everyone else and that they like to have fun and hang out with friends and family as well! its a very unfortunate incident that happened.... my condolences go out to the mans family and friends!

I can't believe I'm defending one of his posts, but the word probably (or the abbreviation of it) spelled out pretty clearly he was speculating and not claiming first hand or absolute knowledge.

Still silly to put a game first case and point IMHO.
