The NFL is looking into whether or not a party for the pornography industry illegally used images of NFL players to promote the event in Miami last month.

NFL spokesman Brian McCarthy told ABC-7 in Chicago that the league was looking into the matter involving Exxxotica Expo 2011. An advertisement you can see here featured photos of five current NFL players – Kansas City Chiefs defensive backs Brandon Flowers and Eric Berry, Houston Texans defensive back Kareem Jackson, Oakland Raiders wide receiver Jacoby Ford and Chicago Bears safety Major Wright.The ad identified the players as hosts of the party, along with some stars from the adult entertainment world.

Also listed were three draft picks, most notably Corey Liuget of the San Diego Chargers. The draft picks, including Miami Dolphins running back Daniel Thomas and Baltimore Ravens running back Anthony Allen, were not pictured.


“The NFL office works on behalf of the clubs to protect their intellectual property rights in matters such as this,” league spokesman Brian McCarthy told the television station.


“Our legal team is reviewing the ad. In general, companies not affiliated with the NFL or its clubs may not depict a player in his uniform.”

There is nothing wrong with players hosting parties like this, but trademark issues come into play when players are shown in uniform.

I am surprised to learn that players can't be depicted in their NFL uniform without NFL consent. I wonder if any other organizations are allowed to make that IP claim, like the US military, Boy Scouts, Police departments, etc. I don't see how the NFL can make that claim unless they own the picture in question, in which case it becomes a copyright issue. If the photographer who owns the pictures sold the rights to this group to use in an ad, why should the NFL have any say over that material?

As the bolded sentence is not within quotes I am assuming this is your view rather than NFL. I would think NFL would not want to have the uniformed players in advertizing porn. Conduct detriminal to league or something?

I have heard that women in police departments have been terminated for "playboy" type pictures while in uniform.

Well, not that he put the flyer together....but that's obvious. You can't use company images without their consent and since it's the NoFunLeague I'm guessing this isn't on the list of approved uses.

I was in a drum corps, one that was down a few rungs on the ladder, so to speak. We had to sign every single year that once we were in uniform, our images could be used by anyone for anything related to drum corps. Basically at that point, our image was owned by someone else. That's for stupid ass DRUM CORPS. You think the NFL doesn't have something about a million times more intense?

Definitely not the kind of thing you want to see your first round investment getting into and spending his money on. But.....it's his thing....and his money....I just wish he was spending time covering receivers instead of promoting them.

This has been in effect for as long as I can remember, unless the company is an official NFL sponsor, when a player appears in the commercial they have to wear street clothes or a non any team uniforms.

MLB and the NBA also protect there brands in this manner.
