TMZ has learned the former Notre Dame football star was caught trespassing inside a Top Pot donut shop in Bellevue, Washington at 3 AM Saturday morning.

Cops would only confirm that Tate was given a "trespass warning" -- and was not arrested -- but they wouldn't expand on why the 21-year-old was inside the store while it was closed.

We spoke to the manager of the Top Pot shop ... who said he would not be commenting on the matter. On a related note, Top Pot recently inked a deal to become the official coffee and donut partner of Qwest Field -- home of the Seattle Seahawks.

Calls to Tate's rep have not been returned.

Marijuana has to be involved. I cannot grasp this story any other way.

Tate says a friend took a couple of maple bars from the shop, which is at the bottom of the building in which Tate lives.

He says "they are irresistible."

Seahawks coach Pete Carroll says he has talked to Tate, and agrees that maple bars can be irresistible.

Scratch that. I think Ron Dayne framed him.

Dayne: "OK, kid. Here's what you do. Break the glass, go in there, and bring me back two boxes of jelly-filled donuts with powdered sugar on top. Then YOU get to go back in there and get your boxes for yourself. You'll have plenty of time before the cops get here."

Tate: "You sound like you've done this before."

Dayne: "Yeah. Hey, you wanna' get an apartment with me when this thing blows over?"
