.....for the old players bringing the suit. What a deal! As far as the new players covered, I think that if most retired from football at around 35 years old, an average of 40 years (if they live that long) after football would afford them a 3500/year pay out. What an insurance policy!

Jeff, have you learned nothing? No one knows what a judge, a jury, or (in the case of federal appeals) a three-judge panel will do. Reasonable minds can reasonably differ, and if this case were absolutely, objectively groundless, it would have been thrown out short of trial.

Even if Kessler has great arguments to support the union’s position on appeal, the bluster serves no purpose.

Then again, maybe Kessler’s real audience is the members of the union. Since the appeal most likely won’t be resolved before a new Executive Director is hired and since the current power structure of the union is undoubtedly hoping to steer the process toward a candidate who won’t fire everyone whose fingerprints are on the litigation, Kessler and interim Executive Director Richard Berthelsen could be aiming for the hearts and minds of their constituents.

And that’s likely one of the reasons for the union’s attempt to point out that the defense team averted a worst-case scenario of $90 million. At a time when (as we hear it) players are livid regarding the outcome of the case, Berthelsen and Kessler need to come up with creative ways to convince a potentially angry mob that they’re not incompetent.
