Weary is at it again.....

A Houston Texans player is under investigation for possible domestic battery. The Houston police department Friday confirmed that Texans lineman Fred Weary is under investigation for an incident that occurred at a local swingers bar.

In the police report, witnesses told HPD that for some unknown reason Weary started a fight inside the club breaking tables, chairs and glasses. When people tried to stop him, the report states pushed them around as well.

The big Texans lineman allegedly threw a drink on a female family member and then assaulted her.

Great, this should make for an interesting offseason for the linemen.

I'm a little confused by the report ? It says he is now "in the spotlight again".
I'm thinking that in reference to the incident origionally reported at the "Secrets" establishment which was 2 weeks ago, but seems a bit unclear ?
At any rate even the Texans, even as closely as they monitor they're players and these character issues, will have a few bumps in the road along the way.

Investigative sources told 11 News that female was Weary's wife. According to the report, they were at the club with several others for a bachelorette and bachelor party.


Davis Stevenson, who works at the club, was the main complainant on the report. Weary has not been charged or arrested in relation to this most recent incident.

It is unusual for the police to be called out somewhere for a fight and NOT have charges filed on someone. Usually the police arrest people and then let the court system figure stuff out. Something doesn't smell right. Either the evidence was really not good at all, or he is getting special treatment. No way to tell.

If Weary paid the swingers club owner for the damages, then there is no motive for him to prosecute. However HPD is still investigating him for "assaulting" his wife. And as the Warren Moon case showed, the state can still prosecute without the wife's cooperation.

Yeah, but in most circumstances like this, they IMMEDIATELY arrest the husband, then let the legal system sort it out. They don't think about it and investigate it later.

If a husband and wife fight, and the police get called, usually the husband is the one that gets arrested (unless he looks like he got the worst of it). Even if the case is BS. Then it goes through the legal system, lots of money is spent on lawyering, and then if the case is total BS it gets dismissed.

So, either a. the evidence was really really really weak or b. he is getting special treatment.

I haven't spoken to anyone yet, but my guess is the evidence is really, really weak.

Editorial aside: Weary's an intriguing character. On the one hand, everything I know or have heard points to the kind of guy who wouldn't be investigated for assaulting his wife and wouldn't be tasered. On the other hand, these events have transpired. I guess it's true that you never really know anybody (probably an ironic point on a message board).
